Carlson OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS CITY COUNCIL REGULAR COUNCIL MEETING SEPTEMBER 23, 1991 The Council Meeting was cai]ed to order by Mayor Carlson at 7:00 1. CONSENT AGENDA The following items were approved on the Consent Agenda: Minutes for Approval The Council approved the minutes of the September 9, 1991 Council Meeting as presented and there were no corrections. Resolution No. 91-49; Regarding a Labor Agreement The reading of the resolution was waived there being ample copies available for the public. RESOLUTION NO. 91-49 BEING A RESOLUTION REGARDING LABOR AGREEMENT BETWEEN THE CITY OF COLUMBIA HEIGHTS AND MINNESOTA TEAMSTERS PUBLIC AND LAW ENFORCEMENT EMPLOYEES' UNION, LOCAL NO. 320 - POLICE SERGEANTS BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights that: WHEREAS: The present agreement between the Minnesota Teamsters Public and Law Enforcement Employees' Union, Local 320, representing Sergeants of the City's Police Department and the City of Columbia Heights has a wage and contribution to fringe benefits reopener for calenc%~r year 1992; and, WHEREAS: Negotiations have proceeded between the Minnesota Teamsters Public and Law Enforcement Employees' Union, Local 320, representing Sergeants of the City's Police Department, and members of the City negotiating team, and said negotiations have resulted in a mutually acceptable provision regarding the following articles: Wages - 3.0% adjustment effective February 1, 1992 (2,7% net adjustment) REGULAR COUNCIL MEETING SEPTEMBER 23, 1991 PAGE 2 ~nsurance - $250 per month employee contribution for employees and dependent coverage effective January l, 1992 WHEREAS: A copy of said contract will be made available for inspection at the Office of the Mayor and is made a part hereof by reference; NOW, THEREFORE, BE IT RESOLVED that the contract amendments as negotiated, be and are hereby established as the salary and fringe benefit adjustments for calendar year 1992 for Sergeants of the Columbia Heights Police Department. BE IT FURTHER RESOLVED that the Mayor and City Manager are hereby authorized to execute this agreement. Passed this 23rd day of September, 1991. RESOLUTION NO. 91-51 BEING RESOLUTION REGARDING AMENDMENTS TO THE LABOR AGREEMENT BETWEEN THE CITY OF COLUMBIA HEIGHTS AND THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, LOCAL NO. 1216 WHEREAS: The present agreement between the International Association of Firefighters, Local No. 1216, and the City of Columbia Heights has a wage and contribution to fringe benefits reopener for calendar year 1992; and, REGULAR COUNCIL MEETING SEPTEMBER 23, 1991 PAGE 4 WHEREAS: Negotiations have proceeded between the International Association of Firefighters, Local 1216, representing Firefighters and Captains of the City's Fire Department, and members of the City's negotiating team, and said negotiations have resulted in a mutually acceptable provision regarding the following articles: Wages - 3.0% adjustment effective February 1, 1992 (2.7% net increase) Insurance - $250 per month contribution for employee and coverage, effective January 1, 1992. employer dependent WHEREAS: A copy of said contract will be available for inspection at the Office of the City Manager and is made a part thereof by reference. Carlson Jo-Anne Student, Council Secretary purchase of Christmas Decorations The Council authorized the purchase of 38 white/blue snowflake Christmas decorations from Dispaly Sales, Inc. of Eden Prairie, Minnesota, in an amount of $7,980. License Applications The Council approved the license applications as listed upon REGULAR COUNCIL MEETING SEPTEMBER 23, 1991 PAGE 5 Approval of Bill. Payment The Council approved the payment of the bills as listed out of proper funds. APPROVAL OF CONSENT AGENDA Motion by Nawrocki, second by Clerkin to approve the consent agenda as presented. Roll call: All ayes OPEN MIKE/PROCLAMATION/PRESENTATIONS Merrill Emerson, 4124 Seventh Street, advised the Council of the neighborhood concern with regard to the vacant house located at 4116 Seventh Street. He noted it has been vacant since February of 1988 and has generated numerous police calls. Mr. Emerson described the house as being in particularly poor shape, both inside and out. He noted that most of the utilities have been shut off. It was his understanding that the property had been sold in 1988 and the buyer intended to build a home on the land after demolishing the present structure. Mr. Merrill presented a petition bearing signatures of twenty- eight nearby property owners requesting the property be cleaned up or torn down. Motion by Nawrocki, second by Clerkin to accept the petition and place it on file and to direct the City Manager to review the property and report back to the City Council. Roll call: All ayes The City Manager advised that the buyer had requested a building permit which was denied as the proposed home was smaller than that required by the City. Presently, condemnation is being pursued and that a public hearing on this matter will be scheduled for the first or second Council meeting in October. The City will raze the structure thirty days after the public hearing if this is necessary. Mr. Merrill also requested that residents be advised that it is a violation of City ordinance to throw or push snow into alleys or streets in the City. He suggested this reminder be put into utility bills. 6. ORDINANCES/RESOLUTIONS There were no additional ordinances or resolutions to those already addressed on the Consent Agenda. REGULAR COUNCIL MEETING SEPTEMBER 23, 1991 PAGE 6 COMMUNICATIONS There were no communications. Request to Seek Bids for Replacement of Sewer Vactor, Municipal Unit #125 Counctlmember Nawrocki inquired if there is any value left in the unit which is presently being used. Public Works Superintendent Jolly responded that it is still functioning but has some problems developing, particulary in the uDDer engine. He added that it also requires considerable crew time to service and clean. He noted that the costs to service and maintain it are quite high. Jolly stated he knows of no other machine like this which is still being used in the area. It was his opinion that the machine would have some value to some other community which would not use it as often nor as extensively as does our City· Councilmember Nawrocki felt if the unit were used for even two or three more years the City would benefit. The City Manager stated that staff concern is with the availability of repair parts and the possible time necessary for repairs which could take up to a year. Mayor Carlson inquired as to the trade-in value of the unit. Jolly responded it could be between ten and twenty thousand dollars. Motion by Ruettimann, second by Peterson to authorize staff to seek bids to replace Municipal Unit #125, a 1970 Vacto 400 and that the City Manager is requested to seek information on the value of the current Vactor owned by the City. Roll call: All ayes OLD BUSINESS Purchase of Pick Up With Service Body The City Manager briefly reviewed the history of this purchase. He noted that none of the bids received were able to match the paint color exactly as stated in the specifications but they all came close. Motion by Clerkin, second by Ruettimann to award the bid for the three-quarter ton pick up truck with service body to North Star Dodge of Brooklyn Center for an amount of $19,395, including trade-in of Municipal Unit #157; and furthermore, to authorize the Mayor and City Manager to enter into an agreement for same. It was noted that on REGULA/~ COUNCIL MEETING SEPTEMBER 23, 1991 PAGE 7 the agenda material the trade-in figure was incorrect. It should be $500.00. Roll call: All ayes Authorization to Hire Engineering Services for Jackson Pond Reconstruction The work involved in this project includes an evaluation of the site and determination of the cause of failure as well as the preparation of plans and specifications for the reconstruction of the wall. The engineering proposal has been reviewed by the City Attorney if this matter goes to court and the bonding company has been advised of the action to employ the services of an engineering firm. Motion by Ruettimann, second by Clerkin to authorize the retention of Twin City Testing Corporation to determine the causes of failure of the wall and to prepare plans and specifications for the reconstruction of Jackson Pond wall, Municipal Project #9126, for an amount of $12,875; and furthermore, to authorize the Mayor and City Manager to enter into an agreement for the same. Roll call: All ayes NEW BUSINESS a o Purchase of Land From Mennepin County Regional Railroad Authority (HCRRA) This land was purchased by Hennepin County from the Cargill Company for seventy-five cents per square foot for use with the Light Rail Transit project. They no longer have use for the land for this purpose and have offered to sell it to the City of Columbia Heights for the same price. Councilmember Nawrocki advised that Mennepin County did some soil testing on this land and is still waiting for the results. The City Manager stated that the purchase will not take place until the site is found to be satisfactory as a result of an environmental assessment. Motion by Ruettimann, second by Peterson to concur with the HRA's planned action on acquiring the subject 79,279.2 square feet of land (as per legal descriptions as on file in the City Hall) from the Hennepin County Regional Railroad Authority for $59,460 with funding for such purchase from the HRA Community Development Restricted Reserves Fund. Roll call: All ayes REGULAR COUNCIL MEETING SEPTEMBER 23, 1991 PAGE 8 10. HVAC Maintenance Contract The City has sixty heating, ventilating and air conditioning pieces of equipment. During the 1990-1991 contract period, eighty-five service calls were made on thirty-three units and $4,604 worth of parts were replaced. The HVAC maintenance contract being recommended by staff will cover twenty-four hour, seven days each week, year around service for call outs; two servicing and inspections visits for each unit of equipment and full coverage for all labor on other call outs and repairs as well as the cost of some replacement parts. Motion by Peterson, second by Clerkin to authorize the 1991-1992 HVAC Maintenance Contract with Minnegasco in an amount of $9,950 and furthermore, to authorize the Mayor and City Manager to enter into the same. Roll call: All ayes C · Municipal Project #9110 - Resurfacing Municipal Service Center Floor The City Manager advised that the bids had been sent out three weeks ago and only one has been received at this time. The Public Works Director stated that the businesses who do this type of work are not very big and need prodding to bid. Motion by Nawrocki, second by Peterson to reject all bids for Municipal Project #9110 on the basis that bids exceed estimates for the work and furthermore, to authorize the City Manager to re-advertise the project. Roll call: All ayes REPORTS Report of the City ManaGer The City Manager's report was submitted in written form and the following items were discussed: 1.Community Survey Responses: 830 surveys have been returned to City Hall by residents. It was felt this was a very good response. 2. Costs for Civil Lawsuit: This lawsuit occurred during the time the City was self-insured. The services of Marsh and Associates of Circle Pines have been employed as this firm has an impressive history of activity in civil rights litigation. The motion to release the City from REGULAR COUNCIL MEETING SEPTEMBER 23, 1991 PAGE 9 the lawsuit is on the court calendar the third week in October. Motion by Peterson, second by Ruettimann to authorize payment of $4,500 to Marsh and Associates for legal services rendered. Roll call: All ayes 3. Water Booster Pump Station *2: Copies of a letter received from Maier Stewart & Associates, consulting engineers, was distributed to the Council. The letter addressed three options for upgrading the Water Booster Pump Station *2. The advantages and disadvantages of each option were discussed as were sources of funding for whatever option was chosen. Anticipated uses for reserve funds were considered. Some members of the Council favored option two or three. Staff was requested to provide more information on these two options and on sources of funding. 4. Hearing Date for Light Rail Transit Public Hearing: Motion by Nawrocki, second by Ruettimann to establish a public hearing for Light Rail Transit proposed by Anoka County on Tuesday, October 15, 1991, at 7:$0 in the Council Chambers. Roll call: All ayes Motion by Nawrocki, second by Clerkin that following the completion of this Council Meeting and the Board of Trustees Meeting, the City Council go into a Council Work Session.
