HomeMy WebLinkAboutNovember 19, 1991OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS CITY COUNCIL PUBLIC HEARING NOVEMBER 19, 1991 The Public Hearing was called to order by Mayor Carlson at 7:00 p.m. ROLL CALL Nawrocki, Clerkin, Ruettimann, Peterson, Carlson - present PURPOSE OF PUBLIC HEARING The Public Hearing is being conducted for the purpose of adopting assessment rolls for improvements which have been completed on the following projects: Project #8721; Construction of 38th Avenue from 323' east of Fifth Street to Madison Place Project #9101; Sealcoat of all bituminous alleys in the City with exception of nine alleys Project #9115; Alley major repair and sealcoat, Fourth and Fifth Streets, 52nd to 53rd Avenues Project #9106; Alley construction from Third Street to Trunk Highway 47 between 44th and 45th Avenues Project #9107; Alley construction from Sixth to Seventh Streets between 41st and 42nd Avenues Project #9108; Alley construction from Taylor Street to Fillmore Street between 45th and 46th Avenues P.I.R. #880; Miscellaneous delinquent bills from weed control and shade tree programs QUESTIONS AND ANSWERS Stanley Van Blaricom, who owns rental properties at 4513 - 4515 Taylor Street and 4507 Taylor Street, stated he felt his assessment for alley reconstruction was not equitable since he has no access nor use for the alley. He noted there is a high bank behind his properties at 4513-4515 Taylor and it would require a great deal of fill if he were to access the alley. The Public Works Director stated that the policy of the City has always been to assess benefitting properties. This policy considers the potential or future use which may be made of the alley. Mayor Carlson observed that a future plan for this area may be to fill it in and build garages for the tenants. PUBLIC HEARING NOVEMBER 19, 1991 PAGE 2 o For the record, Mayor Carlson acknowledged receipt of letters from the following property owners: Donald Rozycki, Re: 4240 Central Avenue; who states his concern regarding being assessed for an alley improvement where there is no access to the alley from his property. Danny Wellner, Re: 4540 Stinson Boulevard; who is concerned with a low spot in his newly-sealcoated alley where water ponds. The Public Works Director advised that sealcoating would not correct a drainage problem. Joseph Ozasky, Re: 4233 Van Buren Street; he objects to paying the assessment for the sealcoating as water ponds on his driveway. It was again advised that sealcoatinG will not correct water problems. Councilmember Nawrocki questioned some of the sealcoatinG work which left a gap between paving and driveway surfaces in the alley from Taylor to Fillmore, 45th to 46th Avenues. The City Manager advised that the practice is to only replace what had been torn out. Councilmember Ruettimann questioned the width on the alley from Third Street to Trunk HiGhway 47 between 44th and 45th Avenues. He noticed that it visibly narrowed on the south portion of the alley. It was presumed that the snow plow had gone off of the edge of the alley and that the alley construction was actually wider than it appeared after it had been plowed. Councilmember Nawrocki inquired why there was no backup material included in the agenda packet for P.I.R. #880, miscellaneous delinquent bills from weed control and shade tree programs. The Assessment Clerk supplied a copy of this material. A five minute recess was taken at 7:20 p.m. to review the backup material for P.I.R. #880. Councilmember Nawrocki requested more complete information for two delinquent miscellaneous weed control and shade tree program bills. ADOPTION OF ASSESSMENT ROLLS RESOLUTION NO. 91-68 Motion by Clerkin, second by Peterson to waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes PUBLIC NEARING NOVEMBER 19, 1991 PAGE 3 RESOLUTION NO. 91-68 Adopting assessment rolls according to the City Charter for the following local improvements and determining that said improvements have been made and ratifying and conforming all other proceedings, heretofore had: Special Assessments numbered 841, 873, 878, 874, 875, 876, and 880. WHEREAS, the City Council of the City of Columbia Heights, Minnesota, met at 7:00 o'clock p.m. on the 19th day of November, 1991, in the City Council Chambers, 590 40th Avenue N.E., Columbia Heights, Minnesota, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to benefits, and to the proportion of the cost of making the local improvements above described, a notice of such hearing having been heretofore duly published as required by law, and a notice mailed to each property owner of record, stating the proposed amount of the assessment; and, WHEREAS, this Council has heretofore estimated and fixed the cost of such local improvements and has prepared an assessment roll therefore, THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVES: Section 1. That this Council does hereby adopt the aforesaid assessment rolls known and described as "Assessment Roll for Local Improvements" numbered 841, 873, 878, 874, 875, 876, and 880. Section 2. That this Council hereby finds and determines that each of the lots and parcels of land enumerated in said assessment rolls was and is especially benefitted by such improvement in an amount not less than the amount set opposite in the column headed "Total Assessment" And this Council further finds and determines that the proper proportion of the cost of such improvements to be especially assessed against such lot or parcel of land is the amount set opposite the description of each such lot or parcel of land respectively in said assessment rolls. That said assessment may be paid in part or in full without interest on or before December 20, 1991, or in annual installments for a period of from one to twelve years as designated on each assessment roll, payable on or before the 15th day of September, annually, with 9.5% interest thereon. Failure to pay the annual installment renders the same delinquent and thereafter a 10% penalty is added and the said delinquent special assessment is certified to the County for collection with the real estate tax. Section 4. That this Council did hereby determine and redetermine to proceed with said improvements, does ratify and confirm all other proceedings heretofore had in regard to these improvements, and said improvements shall hereafter be known and numbered as Local Improvements numbered 841 - Project #8721, 873 - Project #9101, 878 - Project #9115, 874 - Project #9106, 875 - Project #9107, 876 - Project #9108, and 880. I have called the City Offices on two occasions to express a concern that the project, as it relates to our property, was not completed properly. As of today, the problem has NOT been resolved. Just north of our garage entry, a low spot still exists which remains a holding pond for runoff. The road department said this would be repaired prior to winter and receipt of our assessment. Once the low spot has been properly repaired, we will be happy to pay our assessment. Columbia Heights, MN 55421 DIn ~841, ~873 Project 8721, 9101 Dear Sir: I have mailed a check for payment of seal coating the alley behind 4240 Central Ave. N.E. I wish, however, to make a complaint about this procedure because the alley has no value to this property owner. There is no access to the above mentioned property or to the lot adjacent to it. There are ~hree lots between 42nd and 43rd Streets presently abutted in the rear by a cement block wall. At one time all three lots had access to traffic out to 43rd Ave. But since the wall was installed these three lots have no rear access to the alley. Because of this condition I feel that having to pay for seal coating an alley that is in essence ~orthless to this and the other property owner is taxation without benefit (representation). Because of the number of property owners who have due access, it is prudent they should%bear the cost of improvement/upkeep of this alley. Considering the numbers of lots between742nd and 43rd (10 or 12 lots) those who benefit should pay. Dividing the cost of seal coating by the 7 or 9 lots plus the 10 or 12 lots adjacent to this alley would equal to a very small increase in their assessments.
