HomeMy WebLinkAboutApril 17, 1990OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS CITY COUNCIL SPECIAL COUNCIL MEETING APRIL 17, 1990 Mayor Carlson cai-led this Speclal Meeting of the City Councll to conduct a Public Improvement Hearing to order at 7:30 p.m.. l. ROLL CALL Ruettirnann, Clerkln, Carlson - present Paterson - absent Nawrockl arrived at the meeting at 7=~O p.m.. 2. PURPOSE OF THE MEETING To conduct a Public Improvement Hearing regarding sealcoating of all bituminous City streets In the Northeast Quadrant of the City. The Northeast quadrant of the City Is bounded by and lncludlng ~$th Avenue on the south, Stinson Boulevard on the east, Corporate Llmlt on the north and Central Avenue on the west. Work will Include selectlve concrete curb and gutter replacement, bltumlnous surface patching and sealcoat appllcation. New cost estimates were distributed at the meeting. The City Manager stated that these are only estimates and that actual quantltles used determine the actual costs. A video was shown which explained the bituminous sealcoatlng procedures. County Road 1Oh is lncluded In this project. IO~ Is made up of a small portion of Johnson Street and Pennlne Pass and ali of West Upland Crest. Mayor Carlson Inquired If lOq will be Included In thls project If Anoka County chooses not to participate. The City Manager stated that the County has already said it would not participate and the Inclusion of IOq is a Councll decision. 3. PRESENTATION OF INFORMATION BY STAFF The City Manager reviewed the entire seaicoat area using graphs and overheads. Richard Junt111a, 2319 North Upland Crest, stated he had a new street Installed in front of his house two years ago. He questioned the need for sealcoating so soon after construction of the street. The Publlc Works Olrector advised this is a procedure which would benefit this street and would result In a better wearing surface. Mr. Junt111a suggested that thls street be 1eft out of the project and done In slx years by itself. He was ~dvlsed when a small area Is done the costs are quite high. Margret Laby, 2123 Forest Drive, stated that her street has roll up bltumlnous curbs and they are in very poor condltlon'as is the street surface. She Inquired If Improvements are planned for the curb. She was advised there were no curb Improvements included In this project. Patching wlll be done In her area, but curbs will not be replaced. Councllmember Nawrockl recalled that about four years ago a proposal was made to replace the street in her area and the area resldents turned this proposal down on an overwhelming basls. Juntilla felt his area will be paying for more than half of the project and they have just been assessed for new streets t~o years ago. He questioned the equlty of this. Counclimember Nawrockl responded that the rational for this is that at this point In time Mr. Juntllla~s street ~111 need no further work for some time. Special Council Meeting April 17, 1990 page 2 But, he noted, that before It was reconstructed It more than likely needed con- siderable repair. He felt that over the years it all balances out. The resident at q6qq Heights Drive requested an explanation of his assessment. He has a corner lot. An explanation was given for an avenue assessment rate and a street rate. He also Inquired if the HTC is assessed as buses use'this street regularly. Councllmember Nawrocki.responded that the MTC Is statutorlaily exempted from local assessments. Gary Mayer, 2115 Highland Place, Inquired if his driveway wlll. be patched before the sealcoating is done. The Publlc Works 01rector responded that the driveway wlll be patched. It was noted that large chunks of asphalt are dug up when snow removal Is done. The City Manager observed that a large number of factors contribute to a bituminous street being torn up; water, vehicles, snow plowlngt etc.. Councllmember Nawrockl requested staff to look at the roll Up curb In this area and see If some patching can be done to Improve the situation. He noted that thls type of patching had been done In the past. Minneapolis also has property in the area of the sealcoatlng. Councllmember Nawrockl Inquired If there had been any response from Minneapolis regarding their position on paying an assessment for thls work to be done. The Clty Manager responded that he had received a call from an employee of the Publlc Works Department advlslng that Minneapolis does not Intend to pay the assessment. The City Manager also had contacted the Minneapolis City Clerk regardlng this matter and received no response. Councllmember Nawrockl stated that the employee of the Public Works Department does not represent the City of Minneapolis. He suggested that'the members of the City Council be contacted regarding this matter. The City Manager will do thls. The total assessment for the City of Hinn~apolls would be $3,528.70. The Anoka COunty share of the assessment is $3,063.49. Mayor Carlson felt that If Anoka County and the Clty of Minneapolis do not participate that the City of Columbia Heights should pay the assessment costs and that they not be put onto the assessment rolls for the affected residents. Councllmember Nawrockl Inquired why we would do something Irrespective of the County's wlshes If they choose not to participate. He Inquired If they have a better way to sealcoat the street. The City Manager advised that the position of the County Is that they want to turn back the road to the City. Council- member Nawrockl observed that turn backs are done but the funding whlch Is allocated for these roads does not follow the turn back. He felt It was not advisable to acquire this road before It was necessary and the road was the CountySs responsibility. The Publlc Works Director advised that the County's Highway Committee had met a week ago to discuss this matter. He had been advlsed verbally that they recommended not to participate in the project for 104. He has received nothing in writing as yet. Mayor Carlson related he had spoken to an Anoka County Commissioner regarding Speclal Councll Heating April 17, 1990 page 3 1Oh and the Commlssloner had Indlcated the County's willingness to contribute to the costs of some reconstructlon and resurfacing to I~ done on 101~. The Public Works Director stated that generally the County doesnet sealcoat but rather they do an overlay. He knows that the piece of road between Reservoir Boulevard and the Ramsay County 1ina is In the Countyts overlay, program for 1990. That portion of Johnson Street on IOq needs some work according to the Publlc Works Director and before a turn back Is done the County traditionally does the work needed. I~otlon by Nawrockl, second by Ruettimann to aroceed with the project; that If It Is the County's decision not to incl~ld~ their road In thls prolecto that it not be included; and, further that staff be directed to Continue ~o pursue a formal response from the City of Hlnneapolls and thelr partlclpation relative to the cost of the streets that abut thei.r property; and some attempt w111 be made to do some patching on the rollover curbs in the project area. Roll call: Al'! ayes 4. CONSIDERATION OF RESOLUTION AUTHORIZING PR0dECT It was noted that no changes need to be made to the resolution relatlve to the motion passed previously In the meetlng. Motlon by Nawrockl, second by Ruettlmann to waive the reading of the resolutlon there being ample copies available to the publlc. Roll call: Ali ayes RESOLUTION NO. 90-25 BEING A RESOLUTION ORDERING IHPROVEHENTS BE IT HEREBY RESOLVED by the City of Columbla Heights by motion on the 2nd day of January, 1990, and on the 14th day of March, 1990, ordered notice of a hearing to be given to property owners; and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council Heating on the 17th day of April, 1990; and WHEREAS, the Council determines to proceed with this local Improvement, a portl~n of the cost being defrayed by special assessments under Charter provlslons. NOW, THEREFORE, BE IT RESOLVED: 1. That the location and extent of such Improvements Is as follows: Sealcoatlng of all bitumlnous City streets in the Northeast Quadrant of the City (Area IV) or that part bounded by and includlng 45th Avenue N.E. on the south, Stinson Boulevard on the east, the Corporate Limlt on the north, and Central Avenue N.E. on the west. Work would include selectlve concrete curb and gutter replacement, bituminous surface patching,~ and sealcoat appllcatlon. 2. That the materials to be used are as follows: Special Council Meeting April 17, 1990 page q Concrete curb and gutter, bituminous patching, asphalt emulsion and sealcoat aggregate. 3. That a careful estimate of the cost of the improvements has been made by the City Hanager and the several lots and parcels of land fronting upon and adjacent to such proposed Improvements, which be deemed benefited thereby, were properly notlfled of said hearings; and That the City Manager shall also list the names and o~ers of the several parcels so improved as nearly as can be ascertained. That the Clty Manager shall proceed with taking of blds for the Improvements, or portions of the Improvements as stated herein. These Improvements shall also be known as P.I.R.#866 - Project 9001.
