PUBLIC IMPROVEMENT HEARING
JUNE 4, 1990
Mayor Carlson called the Public Improvement Hearing to order at 8:07 p.m..

2. PURPOSE OF HEARING
To conduct a Public Improvement Hearing regarding major maintenance and seal-
coating of Tyler Street from 37th to qlst Avenues; Tyler Street from 41st to
q3rd Avenues; 43rd Avenue from Central Avenue to Pierce Street; Royce Street
from McLeod to 44th Avenue; and Leander Lane from Royce Street to 44th Avenue
3. PRESENTATION OF INFORMATION BY STAFF
a. Project 9018; Major maintenance and sealcoating of Tyler Street from 37th
to 41st Avenue. This project's work would include selective concrete curb
and gutter replacement, bituminous surface patching and sealcoat application.
The City Manager reviewed the entire project and advised those in attendance
that new bids were received today. He reviewed the costs included in these
bids. He noted that originally a two year assessment period had been recom-
mended but in light of these new b'ids this time period may change. The bids
reflected a decrease in the costs. He also advised that there will be selective
curb replacement between 39th and 41st Avenues for a total of approximately
150 feet. There wi1! be no se)active curb replacement between 37th and ~gth
Avenues as the curb is in very poor condition. There was some discussion with
property owners ~egarding the installation of curb on the west side of Tyler.
There are a tota) of lOb parcels inc)uded in this assessment project.
b. Project 9019; Major maintenance and sealcoating of Tyler Street form 41st
to 43rd Avenues. This project's work would include selective concrete curb
and gutter replacement, bituminous surface patching and sealcoat application.
The City Manager reviewed the entire project and stated that new bids for
this project were received today. He reviewed the costs included In these
bids. He noted that the policy for assessments is that the avenue rate is
one third of the street rate. There are forty parcels included in this
project. Initially a four year assessment period was recommended but that
this may be modified downward because of these new lower bid costs.
Discussion continued regarding some of the affected property owners obser-
vations about their street and its condition. The history of watermain
breaks in the area was reviewed. It ~as noted that this project area had
been brought to the Council a number of times in the past with staff recom-
mendations to replace the water pipes and to do other Improvements. At
each hearing regarding.these recommendations it was noted that property
owners were opposed to many of the recommended improvements and ultimately
the recommendations were defeated.
The property owner at 4112 Tyler Street inquired if the water pressure in
his area had been reduced. He was advised that it had not but the water lines
are small for the service. The Public Works Director stated that the water
pressure and the valves are checked regularly.

The resident at 4111 Tyler Street inquired if the appearance of the street
will change after this project is completed. The Public Works Director
responded that it will look like a complete surface and should last about
seven or eight years. He noted that the original proposal for this street
would have lasted about forty or fifty years but that the property owners
in the area requested the Council to not do the long lasting project.
c. Project 9020; Major maintenance and sealcoatlng of 43rd Avenue from Central
Avenue to Pierce Street. This project's work would include selective concrete
curb and gutter replacement, bituminous surface patching and sealcoat application.
The City Manager reviewed the project and gave the costs of the new bids
received today.
Mayor Carlson advised those in attendance that improvement projects result
from resident requests or petitions.
The resident at !021 43rd Avenue stated his concern about the hump in the
front of his home and noted that the curb 'in this area is in rather poor
condition. The Public t~orks Director responded that the crown of the street
has built up over the years and to remove the crown height the street would
have to be reconstructed. The Public Works Director advised that staff will
look at this property and seek a solution.
The resident at 101l 43rd Avenue stated his opposition to the project and felt
the entire street should be reconstructed. He indicated his willingness to pay
for an entire reconstruction and suggested that his neighbors agreed with him.
Councilmember Nawrocki advised that this street has been slated many times for
reconstruction but when the hearing was held the property owners simply did
not want to pay for this type of project. He recommended that the resident
at )0l) 43rd Avenue circulate a petition for reconstruction of the street among
his neighbors and present it to the Council. This resident suggested that the
portion of 43rd Avenue which meets Central Avenue be modified into a cul-de-
sac or a deadend road. Adequate space for emergency vehicle turn arounds was
a staff concern with this suggestion.
Discussion continued regarding the potential success of a petition to have
the street reconstructed. It was noted that there are a number of residents
on the street who have fixed incomes and may not want to participate in paying
for reconstruction.
d. Project 9022: Major maintenance and sealcoating of Leander Lane from Royce
Street to 44th Avenue. The work of this project would include selective concrete
curb and gutter replacement, bituminous surface patching, and sea)coat ap-
plication.
The City Manager reviewed the project as well as the new rates for assessment
which were received today. He noted that orlgina)ly a five year assessment
period had been recommended but this may be adjusted downward.
What is exactly being proposed for improvements was discussed. A resident inquired
if the Council is considering using road maintenance funds from the City's General
Fund for the purpose of paying for projects such as this. He referred to the
policy of the City of St. Anthony for paying for major construction projects.

Councilmember Nawrocki felt this could raise questions of equity. He noted
that taxes can be taken off income tax but assessments cannot and since
tax-exempt properties pay assessments but do not pay taxes there are pros
and cons to this issue.
Discussion continued regarding the actual authorization for taking bids for
these projects and how many bids were received. The bid figures will be pre-
sented to the Council at its June llth Council meeting.
Councilmember Nawrocki proposed that maintenance work be done on streets on
the same basis as the sealcoating procedures and be done at the original
quotation of $2.13 per street charge and a third of that per avenue charge.
He recommended that the ba]ance of the costs be taken from the Unallocated
General City Fund. If the property owners on 43rd want a new and better street,
he suggested they petition the Councll for it and that all improvements be
done on a petition or request basis.
Councilmember Ruettimann was called away from the meeting at 8:55 p.m.
Councilmember Peterson stated that he knew Councilmember Ruettimann had
some concerns regarding the proposed projects and requested that this
hearing be continued to accommodate the concerns of Councilmember Ruettimann.
4. CONTINUATION OF PUBLIC IMPROVEHENT HEARING
Motion by Nawrocki, second by Peterson to continue the Public Improvement
Hearing until Monday, June 18th at 8:00 p.m. and that a letter go out to
every person involved in the potential assessment that the hearing is being
continued, and if they wish to have more done in their area than is being
proposed, that they should petition their neighbors and bring their petition
to that hearing.
Councilmember Clerkin apologized to the residents in attendance since this
continuation will necessitate their attending another hearing if they so
desire.
