CONTINUED PUBLIC HEARING
JUNE 18, 1990
The Continued Public Hearing was called to order by Mayor Carlson at 8:00 p.m..
1. ROLL CALL
Nawrocki, Clerkin, Ruettimann, Peterson, Carlson - present
2. PURPOSE OF. MEETING
To continue the Public Improvement Hearing regarding major maintenance and seal-
coating of Tyler Street from 37th to 41st Avenue; Tyler Street from 4]st Avenue
to 43rd Avenue; 43rd Avenue from Central Avenue to Pierce Street; Royce Street ,
from McLeod to 44th Avenue; and Leander Lane from Royce Street to 44th Avenue
3. ACKNOWLEDGEMENT OF PETITIONS/LETTERS RECEIVED
One petition, dated June ll, 1990, was received signed by six property owners,
supporting the street repair of Tyler Street, 41st to 43rd Avenues, as or~iginally
proposed.
One letter was received from a resident on 43rd Avenue requesting the Council
to delay any decision on the repair of 43rd Avenue between Central Avenue and
Pierce Street.
4. PRESENTATION OF INFORMATION BY STAFF
Ail of the projects under consideration at this continued public improvement
hearing had been extensively discussed at the first public improvement hearing.
The City Manager briefly reviewed each project and cited the new costs being
proposed.
a. Project 9018, PIR 868; Major maintenance and sealcoating of Tyler Street from
37th to 41st Avenue. Work ~ould include selective concrete curb and gutter re-
placement, bituminous surface patching, and sealcoat application.
This project includes !02 privately-owned parcels and two parcels owned by the
City. There was limited discussion.
Councilmember Clerkin advised that the Public Works Director has a plan for
the entire City so residents can be informed approximately four or five years
ahead of time as to what will be happening in the future.
b. Project 9019; PIR 869; Major maintenance and seal¢oating of Tyler Street from
41st to 43rd Avenue. Work would include selective concrete curb and gutter re-
placement, bituminous surface patching and seaicoat application.
Councilmember Eawrocki explained the engineering and administrative charges for
projects. The City Manager further explained the process necessary to prepare
an improvement. The Public Works Director advised that a regular sealcoating
schedule was not put into place until 1980.
A resident whose property is located in the Project 9019 area stated she felt
the letter she and her neighbors received from the City Manager was less than
satisfactory. The letter suggested if the residents wished to have more done
to their street than was being proposed they could circulate a petition for
presentation to the Council for action.
Public Hearing
The City Manager stated he felt the letter reflected the wishes of the Council.
Councilmember Nawrocki stated this letter had been sent after the last hearing
at the request of the Council and it was accurate.
The Public Works Director explained what is being proposed for this project.
Councilmember Nawrocki felt a good maintenance program is preferred, particularly
on this section of Tyler Street. He felt the street had been discussed for some
time and that no conclusions had been drawn because of the history of watermain
breaks and resident opposition to specific repair to it. He felt the history of
the watermain doesn't support digging up the watermain and replacing it.
Motion by Nawrocki, second by Carlson that projects 9018 and 9019 be approved
for major maintenance and sealcoating of Tyler Street from 37th to 41st Avenues
and Tyler Street from 41st to 43rd Avenues; work to include selective concrete
curb and gutter replacement, bituminous surface patching and sealcoat application;
and furthermore the assessment be the same amount to be levied for the sealcoat
project for the Northeast Quadrant and the balance of the costs will come from
General Unallocated Funds of the City.
Cou~c!lmember Nawrocki stated he is aiming for a general maintenance program
for streets and if property owners want more done on their streets they should
petition.
Councilmember Ruettimann observed that if the Council wishes the employees to do
the job they should authorize the equipment needed. Councilmember Peterson felt
if the policy to do maintenance and have a large part of the project charged
to General Funds is adopted that this must be addressed in the budget. Mayor
Carlson suggested the interest on the reserves could be used.

c. Project 9020, PIR 834; Major maintenance and sealcoating of 43rd Avenue from
Central Avenue to Pierce Street and work would include selective concrete curb
and gutter replacement, bituminous surface patching and sealcoat application.
A resident of 43rd Avenue inquired what the condition of the sewers are in this
area. The Public Works Director advised only patching and sealcoating are being
considered at the present time. He stated that before any major reconstruction
is considered the sewers would be viewed.
Previously a resident of 43rd Avenue had indicated he intended to circulate
a survey requesting major reconstruction for this street. Some of the residents
in attendance indicated they were not suppOrtive of major reconstruction. Others
stated they would support this but requested an estimate of the costs. Staff
was not prepared to give estimates at this time and did not know if any sewer
~epidcemenc would be warranted. Councilmember Nawrocki felt this portion of
the hearing should be continued.
Motion by Clerkin, second by Peterson to continue the hearing.of Project 9020
until Monday, June 25, 1990 at 6:30 p.m. and that the project be first on the
agenda. Roll call: All ayes
d. Project 9022, PIR 822; Major maintenance and sealcoating of Royce Street from
McLeod to 44th Avenue and work would include selective concrete curb and gutter
replacement, bituminous surface patching and sealcoat application.

Some of the residents in attendance offered their opini.ons as to what they
felt should be done with this street. Councilmember Nawrocki advised the
assessment for a good patching job and sealcoating would be $2.13 if the
project were treated the same as the project on Tyler Street and would include
practically no curb work being done.
Motion by Clerkin, second by Nawrocki to approve Project 9022 as stated in
the agenda with the assessment rate of $2.13. Roll call: All ayes
e. Project 9021, PIR 858; Major maintenance and sealcoating of Leander Lane
from Royce Street to 44th Avenue with work including bitiminous surface patch-
ing and sealcoat application.
The resident at 4234 Reservoir Boulevard felt there was not enough traffic
on Leander Lane to justify any work on the street. It was observed that some
of the residents on Reservoir Boulevard use this street as their alley.
Two residents of Leander Lane felt the street should be repaired and that
it was in terrible condition.
Motion by Nawrocki, second by Clerkin to approve Project 9021 as stated in
the agenda with the understanding that the work be assessed at $2.13 per
running foot for the property owners on both sides of Leander Lane and the
balance of the costs come out of General Unallocated Funds. Roll call: All

5. CONSIDERATION OF RESOLUTIONS AUTHORIZING PROJECTS
a. Resolution No. 90-31; Being a Resolution Ordering Improvements for Project
9018, PIR 868
Motion by Nawrocki, second by Carlson to waive the reading of the resolution
there being ample copies available to the public. Roll call: All ayes

of May, 1990 ordered notice of a hearing to be given to property owners, and
WHEREAS, pursuant .to a notice of hearing certain residents appeared at a Council
Meeting on the 4th day of June, 1990, and on the 18th day of June, 1990; and
WHEREAS, the Council determines to proceed with this local improvement, a portion
of the cost bring defrayed by special assessments under Charter provisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
I. That the location and extent of such improyements is as follows:
Major maintenance and sealcoat of Tyler Street from 37th Avenue to 41st
Avenue.
Work would include selective concrete curb and gutter replacement, selective
cutting and removal of bitiminous surface, bitiminous surface patching, and
sealcoating application.

2. That the materials to be used are as follows:
Concrete curb and gutter, bituminous patching, asphalt emulsion and
sealcoat aggregate.
3. That a careful estimate of the cost of the improvements has been made by
the City Manager and the several lots and parcels of land fronting upon
and adjacent to such proposed improvements, which be deemed benefited
thereby, were propertly notified of such hearings, and
4. That the City Manager shall also list the names and owners of the several
parcels so improved as nearly as can be ascertained.
5. That the City Manager shall proceed with taking of bids for the improvements,
or portions of the improvements as stated herein.
6. These improvements shall also be known as P.I.R. #868 - Project 9018.

Councilmember Ruettimann inquired what would be the disposition of the bid
award if the 43rd Avenue project were change or not approved. The Public
Works Director responded that this portion of the project could be change
ordered out of the bid and that this was part of the bid specs.
The City Manager recommended that the Council not award the bid until June
25th.
6. ADJOURNMENT
