HomeMy WebLinkAboutJanuary 10, 1989OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS CITY COUNCIL SPECIAL ASSESSMENT LEVY HEARING JANUARY 10, 1989 The Hearing was called to order by Mayor Hadtrath at 7:30 p.m.. 1. Roll Call Paulson, Carlson, Hadtrath - present Petkoff, Paterson - absent Mayor Hadtrath noted that Counciimember Paterson was attending an HRA meeting. 2. Purpose of Hearin9 To establish special assessments for various public Improvement projects considered to be complete and or ready for assessment and to consider a resolution which will officially levy special assessments. Presentation of Informatlon by Staff a. PtR #829, Construction of 41st Avenue from 4th Street to Central Avenue The estimated costs for this project were $46.65 street rate and $15.55 avenue rate. The actual costs are $31.32 street rate and $10.44 avenue rate. It was noted that landscaping and sodding on this project will be completed when weather perm)ts [n the spring. The recommended assessment period is ten years at 9.5~. Councilmember Petkoff arrived at 7:55 p.m. b. PIR #830, Construction of 41st Avenue from Reservoir Boulevard to Stinson Boulevard The estimated costs for this project were $50.52 street rate and $16.84 avenue rate. The actual costs are $37.98 street rate and $12.66 avenue rate. It was also noted that the landscaping and sodding not completed will be completed when weather permlts. The Public Works Director indicated he has a punch list of items to be completed by the contractor on many of the projects being con- sidered at this Hearing. The recommended assessment period is fifteen years at 9.5 ~. Discussion followed regarding the condition of 41st Avenue adjacent to the construction work presently being done at the First Lutheran Church. The City Manager advised he has discussed with representatives of the church certain items which will need their attention once the construction has been completed. It was noted by one of the residents that the soil which is near 40th Avenue contains large amounts of broken glass. c. PIR #831, Construction of Second Street from 40th Avenue to 42nd Avenue The estimated costs for this project were $54.75 street rate and $18.25 avenue rate. The actual costs are $41.10 street rate and $13.70 avenue rate. The recommended assessment period is fifteen years at 9.5~ and one year for University Heights. d. PIR #832, Overlay of 39th Avenue from Arthur Street to Cleveland Street and Construction of 39th Avenue from Cleveland Street to McKinley Street For the overlay portion of the project the estimated costs were $15.84 street rate and $5.28 avenue rate. The actual costs are $10.53 street rate and $3.51 avenue rate. For the reconstruction portion of the project the estimated cost was $55.66 street rate and the actual cost is $28.84 street rate. The recommended assessment period is fifteen years at 9.54. Adoption of the Resolution Notion by Paulson, second by Petkoff to waive the reading of the resolution there bain9 ample copies available to the public. Ro11 cai1: all ayes RESOLUTION NO. 89-02 BEING A RESOLUTION LEVYING SPECIAL ASSESSMENTS Adopting assessment rolls according to the City Charter for the followlng local improvements and determining that said improvements have been made and ratifying and conforming all other proceedings, heretofore had: Special Assessments numbered 829, 830, 831, and 832. WHEREAS, the City CouncT1 of the City of Columbia Heights, Minnesota met at 7:30 o'clock p.m. on the lOth day of January, 1989, in the City Councll Chambers, 590 q0th Avenue N.E., Columbia Heights, Minnesota, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to benefits, and to the proportion of the cost of making the local improvements above described, a notice of such hearing having been heretofore duly published as required by law, and a notice mailed to each property owner of record, stating the proposed amount of the assessment; and, WHEREAS, this Council has heretofore estimated and fixed the cost of such local improvements and has prepared an assessment roll therefore, THE CITY COUNCIL OF THE CITY OF COLUHBIA HEIGHTS HEREBY RESOLVED: Section 1: That this Council does hereby adopt the aforesaid assessment rolls known and described as "Assessment Roll for Local Improvements" numbered 829, 830, 831, and 832. Section 2: That this Council hereby finds and determines that each of the lots and parcels of land enumerated in said assessment rolls was and is especlally benefitted by such improvement In an amount not less than the amount set opposite in the column headed "Total Assessment." And this Council further finds and determines that the proper proportion of the cost of such Improvements to be especially assessed against such lot or parcel of land is the amount set opposite the descrlptlon of each lot or parcel of land respectively in said assessment rolls. Section 3: That said assessments may be paid in part or in full without interest on or before February 9, 1989, or in annual instal- lments for a period of from one to fifteen years as designated on each assessment .ro11, payable on or before the 15th day of September, annually, with 9.5~ interest thereon. Failure to pay the annual installment renders the same delinquent and thereafter Special Assessment Levy Hearing January 10, 1989 page 3 a 10~ penalty is added and the said dellnquent special assessment is certified to the County for collection with the real estate tax. Section 4: That this Council did hereby determine and redetermine to proceed with said improvements, does ratify and confirm all other proceedings heretofore had in ~egard to these improve- ments, and said improvements shall hereafter be known and numbered as Local Improvements numbered 829 - Project #8724, 830 - Project #8726, 831 - Project #8723, and 832 - Project #8727. Section 5: This resolution shall take effect immediately upon its passage. Passed this loth day of January, 1989.
