Roll Call Petkoff, Carlson, Paterson, Paulson - present £o~/no Mayor Hadtrath was out of 2. Purpose of Hearin9 To conduct a Public Improvement Hearing regarding various projects which, if undertaken, will result in special assessments. 3. Presentation of Information by Staff a. Project PIR 839, Project 8901 - Sealcoating of all bituminous City streets in the southeast quadrant of the City The City Manager reviewed the project noting the exceptions of those roadways which are not included in the project. The work would include miscellaneous concrete curb and gutter repairs, bituminous surface patching and sealcoat application. He also reviewed the estimated costs and noted that a one year assessment period is being recommended. A number of the residents in the project area who own property on q2nd Avenue inquired why their street wasn't sealcoated when the street was reconstructed a few years ago.-The Public Works Director noted that it has been the policy of the City to not sealcoat newly-reconstructed streets until a few years have passed. Council President Paulson stated he had received a call from the resident at 1213 h2nd Avenue expressing her objection to allowing school buses use any streets in the City but those designated as State Aid Streets. 5he felt these buses should not be allowed the use of any streets and that children could walk to meet t~eir buses on State Aid Streets. Individual questions regarding specific parcels were answered by the Assessment Clerk in another part of the building. Motlon by Petkoff, second by Carlson to approve Project 8901, sealcoating of all bituminous City streets in the southeast quadrant of the City with the noted exceptions. Roll call: All ayes b. Project PIR 8h3, Project 8809 - Tyler Street from 37th Avenue to q3rd Avenue There were three sections to'this project all of which addressed major construction or replacement of various roadways on Tyler Street. The City Manager reviewed all three sections of the project. He also reviewed the estimated costs and noted that a 15 year assessment period is being recommended. A number of residents in the project area voiced their objections to the project. They felt that some of the proposed work was not necessary, noting that very little has been done to this street over a long period of tlme The Public Works 01rector expressed concern with the waterline on Tyler between h2nd and q3rd, noting that there had been some serious waterline breaks in the recent past. It is City policy that the City pays the costs for waterline replacement from the Water Fund and these costs are not assessed back to benefitting properties. Petitions ~ere received opposing all sections of the project. Councilmember Peterson suggested that all of this project could be delayed with the exception of the sealcoating. He felt that a delay might help to focus on the problems being experienced in the area as well as help Public Improvement Hearing March 6, 1989 page 2 those property owners in the area who are still paying off other assessments. Motion by Peterson, second by Carlson to deny that portion of Project 8809 (3-b-l) which addresses reconstruction of Tyler Street from 39th Avenue to 40th Avenue, 41st Avenue to 42nd Avenue, and 42nd Avenue to 43rd Avenue. Roll call: All ayes Recess: 10:37 p.m. Reconvene: 10:42 p.m. Pro~ect 8809 - 3-b-2 & 3-b-3 It was Councilman Peterson's intent to deny the entire project not just the 3-b-1 portion of it. Staff had understood that only the 3-b-1 portion had been denied. The Council was polled and all members concurred that they had voted on denial of the entire project. It was noted that all of the affected property owners of Project 8809 had left the Hearing and it would not be appropriate to continue discussing the remainder of the project. Motion by Paulson, second by Carlson to deny Project 8809 (3-b-2). Roll call: Petkoff, Carlson, Paulson - aye Peterson - abstain Motion by Paulson, second by Carlson to deny Project 8809 (3-b-3). Roll call: Petkoff, Carlson, Paulson - aye Peterson - abstain Staff also recommended that no sealcoating be done on this project area. Motion by Paulson, second by Peterson that no sealcoating be done on Tyler Street, 37th Avenue to 43rd Avenue. Rol1 call: All ayes c. Project PlA 844, Project 8807 - Construction of 39th Avenue from Reservoir Boulevard to Tyler Street The City Manager stated that at the pre-hearing meetings held regarding this project residents indicated their opposition to it. The Public Works Director felt if the project is denied that the sealcoating should still be done as the street needs it. Motion by Peterson, second by Petkoff to deny the Project 8807 with the exception of the sealcoating portion of the project. Roll call: All ayes d. Project PlA 838, Project 8808 - Overlay of Circle Terrace, from 40th Avenue to Reservoir Boulevard This project would include replacement of storm sewer, replacement of selective curb and gutter, additional bituminous surfacing, resodding and miscellaneous associated construction items. Motion by Petkoff, second by Peterson to approve Project 8808. Roll call: All ayes e. Project pIR 842 - Project 8810 - Alley Construction from 46th Avenue to 47th Avenue between Central and Tyler Street Five parcels are affected by this project and a 12 year assessment period is being recommended. There was a lengthy discussion held regarding this project with three of the four affected property owners. It was noted that part of this project would be an improvement to the adjacent parking lots. Councilmember Paulson expressed concern with the project not being done noting that the alley is in very poor condition. Motion by Paulson to approve the project with a fifteen year assessment period. Motion dies for lack of a second. Some of the property owners suggested that the alley could be done on an assessment basis and that they would repair their parking lots, thereby decreasing the amount of the assessment. The Public Works'Director felt Public Improvement Hear|rig March 6, 1989 page 3 spliting the project would realize no savings for the property owners. He also noted that if the alley were completed before the parking lots were completed that water could get beneath the alley surface and break it up. The City Manager suggested that the property owners could do the entire project and donate it to the City. Motion by Peterson, second by Petkoff to deny Project 8810. Resolution 89-10; Being a Resolution Ordering Improvements for Project PIR 839 - Project 890] Motion by Petkoff, second by Peterson to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes RESOLUTION NO. 89-10 BEING A RESOLUTION ORDERING IMPROVEMENTS BE IT HEREBY RESOLVED by the City of Columbia Heights by motion on the 23rd day of January, 1989 ordered notice of a hearing to be given to property owners, and WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council Meeting on the 6th day of March, 1989, and WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions. NOW, THEREFORE, IT IS HEREBY RESOLVED: I. That the location and extent of such improvements is as follows: Sealcoating of all bituminous streets in the Southeast quadrant of the City (Area Ill) or that part bounded by 37th Avenue N.E. on the South; Stinson Blvd. N.E. on the East, 45th Avenue N.E. on the North and Central Avenue N.E. on the West; except 45th Avenue N.E. from Central Ave. to McLeod St., 44th Avenue N.E. from Central Avenue to Reservoir Boulevard, 43rd Avenue N.E. from Central Avenue to Pierce Street, 41st Avenue N.E. from Reservoir Boulevard to Stinson Boulevard, 39th Avenue from Reservoir Boulevard to Tyler Street, and from Arthur Street to McKinley Street, Royce Street, Leander Lane, Circle Terrace, Tyler Street N.E. from 37th Avenue to 43rd Avenue N.E., Polk Street N.E. from 40th Avenue to 41st Avenue ~ Work would include selective concrete curb and gutter repairs, as well a5 bituminous surface patching-prior to sealcoating, That the materials to be used are as follows: Concrete curb and gutter, bituminous patching, asphalt emulsion and sealcoat aggregate. That the City Manager shall proceed with taking of bids for the improvements, or portions of the improvements as stated herein. These improvements shall also be known as P.I.R. # 839 - Project 890]. That a careful estimate of the cost of the improvements has been made by the City Manager and the several lots and parcels of land fronting upon and adjacent to such proposed improvements, which be deemed bene- fitted thereby, were properly notified of said hearings, and 4. That the City Manager shall also list the names and owners of the several parcels so improved as nearly as can be ascertained. 5. That the City Manager shall proceed with taking of bids for the improve- ments, or portions of the improvements as stated herein. 6. These improvements shall also be known as P.I.R. # 838 - Project 8808. Passed this 6th day of March, 1989. PROPERTY OWNER NAME ADDRESS RECEIVED MARCH 6, 1989 PUBLIC IMPROVEMENT HEARING 3/2/89 Columbia Heights City Council Attached please find a petition signed by the property owners concerned with city street project P.I.R. 843-Project 8809: Construction of Tyler Street. N.E. from 39th Ave to 40th ave and 41st Ave to 43rd Ave. On reviewing the project work and cost, we find that by eliminating the use of the new aggregate base as proposed, the cost of the project will be reduced as follows: Original estimate as proposed: Engineering fee of $15,000 to be subtracted $161,781.50 ]5,00O.0O Actual work cost with administration fee $]46,781.50 Aggregate cost Ex~avai i()n cost. $22,913.55 $ 7,325.00 Total aggregate cost $30,238.55 Tolal work cost without use of the new aggregate $116,542.55 or a reduction of 20.6%. The engineering cost, to be reduced by 20% proportion with the other cost. will bc reduc, ed from $15,000.00 $12,000.00 for a total cost of the project of $128,542.95 is a cost reduction of $33,238.55 or a cost. to. the property owner of $24 .55 per foot. On further reviewing the estimated cost as presented, we find that the present street was paved in ]957 and has lasted 32 years and the breakup it has now was mostly caused last summer when ,]]£1. Avenue was being repaired and the trucks ha~jng the aggregate used on that project used Tyler street, almost exclusively. At the meeting on Feb 25, 1989, the city engineering staff stated that by applying the new.aggregate, t.he~ life (~f the streel wo~]d be 30 years which is ]ess then the (~rig~nal work d(,n~ in 1957 wit. h(~ut use of aggregate and at that time %he~ ba~e of the si reel was cci as so]id as it is now. Taking into consideration these fa(~ts, it i~ not l.~ any advantage to spend an additional $33,238.55 since the life of the s~reet wi] ~ not be extended as verified by the city engineer and just be a financial burden on the property owners of which over 50% are senior citizens living on a fixed social security inconm. We respectfully request that the City Council, Mayor and City Engineering Staff consider these facts and support the wishes of the persons paying for the work and not cause undue hardship for them. Public Works Week: Public Works Week will be observed from May 21st to May 27th with an Open House being held on May 23rd.-This item was for informational purposes. 3. Columbia Heights Community Complex Committee - Request for Proposals: It was noted that BWBR has wlthdrawn from consideration as a con- sulting firm for the community complex. 4. Repair Estimate for Damaged City Caterpillar Unit 120: A repair estimate was received from Ziegler, Inc. for the repair of the damaged caterpillar as well as the cost of a rental machine. It was noted that the repair cos(s have increased dramatically. The Finance Director has been advised by. the insurance company that a~ costs associated with the accident will be paid by the other driver's insurance company. Mayor Hadtrath felt the City should have a letter stating the insurance company's intent to pay all costs. b. Report of the City Attorney The City Attorney had nothing to report at this time.
