Roll Call Paulson, Petkoff, Carlson, Peterson, Hadtrath - present 2. Pledge of Allegiance 3. Consent Agenda The following Items were on the consent agenda: Minutes for Approval The Council approved the minutes of the Regular Council Meeting of July 10, 1989 as written and there were no corrections. Varlance - Siekmann, 3937 Pol'k Street The Council approved a four foot rear yard setback varlance to allow the construction of a 22' x 32' detached garage set 16 feet from the rear property line. Special Purpose Fence - Lamont, 5007 Washington Street The Council approved a six foot high special purpose fence for construction at 5007 Washington Street provided the section of fence from the front of the house extending toward the front property line does not exceed 48" in height. Request to Close 46th Avenue from the Alley to Seventh Street The Council approved the closing of 46th Avenue from the alley to Seventh Street on Saturday, September 9, 1989, from !:00 p.m. to 9:00 p.m.. Ratify Action of City Manager In Accepting Van Truck The Council ratified the action of the City Manager in accepting a gift of a van truck from the Columbia Heights Boosters Association. Establishment of a Public He~r.in9 Regarding 1790 Budget The Council scheduled a public hearing regarding the 1990 budget and tax levy to be held on September 19, 1989, at 7:30 p.m. In the City Council Chambers or in the Edgemoor Room at Murzyn Hall, depending upon the status of the City Hal) renovations. Licenses The Council approved the 1989 license applications as listed upon payment of proper fees and waived the fees as Indicated. Payment of Bills The Council authorized the payment of bills as listed out of proper funds. 4. Open Mike/Proclamations The property owner at 5225 Seventh Street advised the Council she is in the process of selling her property. She inquired when Seventh Street is going to be made a one way street in her area. The Public Works Director indicated it would probably happen the second or third week in August. Proclamation - National Night Out - August 8, 1989 Mayor Had'trath read the proclamation regarding National Night Out and encouraged residents to participate. 6. Public Hearings - Ordinances - Resolutions a. Public Hearing - Resolution - Adopting a Bond Program for 1989 for the Issuance of Single Family ~ortgage Revenue Bonds The resolution was withdrawn. The HRA Director advised the Council that there were no funds available for the Single Family Mortgage Revenue Bond Program. He noted that he is hopeful there will be 6unds available next year. Mayor Hadtrath opened the Public Hearing. He stated that there were no funds available for the program therefore, no public hearing was necessary. b. Resolution No. 89-33; Resolution Establishing Date for Public Hearing on Establishing Tax Increment Finagcing District and Tax Increment Finan- cing Program Motion by Paulson, second by Petkoff to waive the reading of the resolution there being copies available for the public. Roll call: All ayes RESOLUTION NO. 89-33 RESOLUTION CALLING FOR A PUBLIC HEARING ON THE MODIFICATION BY THE HOUSING AND REDEVELOPMENT AUTHORITY OF COLUMBIA HEIGHTS OF THE DOWNTOWN CDB REVITA- LIZATION PLAN FOR THE REDEVELOPMENT PROJECT; AND THE ESTABLISHMENT OF THE MULTI-USE REDEVELOPMENT PLAN TAX INCREMENT FINANCING DISTRICT AND THE ADOP- TION AND APPROVAL OF THE TAX INCREMENT FINANCING PLAN RELATING THERETO, LOCATED WITHIN THE REDEVELOPMENT PROJECT BE IT RESOLVED by the City Council ( the "Council" ) of the City of Columbia Heights, Minnesota (the "City"), as follows: Section !: Public Hearing. This Council shall meet on Monday, August 28, 1989, at approximately 7:30 p.m., in Murzyn Hall, 530 Mill Street N.E. to hold a public hearing on the following matters: (a) The modification of the Redevelopment Project by the Housing and Redevelopment Authority by the establishment of the Multi- Use Redevelopment Plan Tax Increment Financing District located within the Redevelopment Project. (bi The modlfication of the Downtown CBD Revitalization Plan for the Redevelopment Project, and (c) The adoption and approval of the Tax Increment Financing Plan for the Multi-Use Redevelopment Plan Tax Increment Financlng Distrlct within the Redevelopment Project all pursuant to and in accordance with Minnesota Statutes, Regular Council Meeting July 24, 1989 page 3 Sections 469.001 to 469.047, inclusive, as amended, the Minnesota Statutes, Sections 469.174 to 469.179, inclusive, as amended. Section 2: Notice of Hearing: Filin~ of Plans. The City Manager is authorized and directed to cause notice of the hearing, substantially In the form attached hereto as Exhibit A, to be given as required by law, to place a copy of the proposed Modified Downtown CBD Revitaliza- tion Plan and proposed Tax Increment Financing Plan on file in the Cit~ Manager's office and to make such plans available for inspection by the public, commencing duly 25, 1989. Resolution No. 89-34; Resolution Establishing a Date for a Public Hearing on an Amendment to the City Comprehensive (Land Use) Plan for 1980 Motion by Paulson, second by Peterson to waive the reading of the resolution there being ample copies available for the public. Roll call: All ayes RESOLUTION NO. 89-34 ESTABLISHING A DATE FOR A PUBLIC HEARING ON AN AMENDMENT TO THE CITY COMPRE- HENSIVE (LAND PLAN) FOR 1980 WHEREAS, pursuant to Minnesota Statutes, Chapter 469.O01 through 469.047 (the "Act"), the City of Columbia Heights, Minnesota proposes to undertake a redevelopment project in the southwest area of the City (Multi-Use Redevelopment Plan (MURP) Project; and WHEREAS, an amendment to the City Comprehensive (Land Use) Plan of 1980 is necessary to make the MURP project proposed development con- sistent with the Comprehensive Plan; and WHEREAS, pursuant to state law and Metro Council requirements a public hearing is required prior to approval of an amendment to the City Comprehen~ sire'Plan following publication of notice thereof in a newspaper of general circulation in the City' of Columbia Heights. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights, Minnesota: l. A public hearing on the Amendment of the City Comprehensive (Land Use) Plan will be held by the City Council on August 14, 1989 at 7:30 p.m.. 2. The City Manager or his designee is hereby authorized and directed (a) to cause notice of such public hearing in substantially the Regular Councll Meeting July 24, 1989 page 4 the form attached hereto to be published in a newspaper of general circulation in the City of Columbia Heights not less than ten (]0) days prior to such hearing; and (bi to cause the Amendment to be submitted to the Metropolitan Council on or before the date.on which such notice is prohibited. Resolution No. 89-35; Being a Resolution Adopting a Proposed Budget for the Year t990, and Setting the Proposed Tax Levy Collectible for the Year 1990 The Finance Director advised the Council of the timeframe changes made by the Legislature for adopting a proposed budget. He noted that this proposed budget is the maximum allowed by law as it cannot be increased, but it can be decreased. Mayor Hadtrath stated that the figures cited in the proposed budget clearly are not the dollar amounts the Council intends to adopt in its final budget but were put into the budget to meet the mandate of the statute and are for compliance purposes. Councilmember Petkoff noted that there will be a public hearing on the proposed budget so residents will have an opportunity to dis- cuss the budget and that all items are individually reviewed during the year when authorization is being requested. Motlon by Carlson, second by Paulson to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes RESOLUTION NO. 89-35 CERTIFYING AND ADOPTING A PROPOSED TAX LEVY AT THE MAXIMUM LEVY LIMIT AND SUBMITTING A PROPOSED BUDGET FOR 1990 FOR THE PURPOSE OF COMPLIANCE WITH MINNESOTA STATUTES AND SPECIFICALLY THE TRUTH IN TAXATION ACT BE IT RESOLVED by the City Council of the City of Columbia Heights as follows: Section A. The following sums of money are levied for the current year collectable in 1990, upon the taxable property in said City of Columbia Heights, for the following purposes: General Fund $2,784,033 Bond & Interest - 0 - Total $2,784,033 The City Clerk is hereby instructed to transmit a certified copy of this resolution to the County Auditor of Anoka County, Minnesota. Communications The minutes of the July 12th meeting of the Planning and Zoning Commission were distributed for informational purposes. No Council action was necessary. 8. Old Business Clover Pond Motion by Paulson, second by Peterson that staff be directed to further Regular Council Heeting ~uiy 24, 1989 page 6 pursue the issue of the control of filamentous algae and bushy pondweed at Clover Pond; and, that findings be submitted to the City Council prior tO resolution of such problem. Roll call: All ayes 9. New Business Fire Training Facility A proposal from the Fridley Fire Chief has been received for the constnuction and shared use of a fire department training facility. The proposal had recom- mended this facility be shared by four fire departments. Mayor Hadtrath is acquainted with this type of facility and felt it could be used by more than four departments. Motion by Pauison, second by Petkoff to aut.horize the City Manager to pursue a joint powers agreement with the City of Frldley and other fire departments for the construction and use of a fire department training facility. Roll call: All ayes 10. Reports a. Report of the City Manager The City Manager's report was submitted in written form and the following items were discussed: 1. Columbia Heights Athletic Boosters' Donation: The Columbia Heights Athletic Boosters donated $3,985 to the Library for purchase of various furnishings to be used in the Library reading area. 2. TVI/Savers: The Council received a status report from the Building Inspector regarding the site improvements at 4849 Central Avenue. He noted that the Letter of Credit is still being held and that there are still some problems with moving of trees and placement of sod. The Building Inspector felt the company may be requesting a reduction in the Letter of Credit at the next Council Meeting. 3. Development of Ordinance P.rohibiting Plastic Containers in the City: The Recycling Coordinator advised the Council that eight other cities have passed ordinances regarding the banning of certain types of plastic containers. The City Manager requested Council input on this matter. Mayor Hadtrath felt this type of legislation should come from the State rather than have individual cities passing separate legislation. Council- member Petkoff also felt this should be considered on a state-wide basis. She felt drafting an ordinance by our City would be premature. The Recycling Coordinator was requested to draft a letter for sending to the City's legislative representatives. 4. Complaint Received by the Minnesota Department of Labor and Industry: An anonymous call was received by OSHA regarding the possibility of hazardous matePial in City Hall, possibly In the Fire Department area. An inspection has been done by OSHA and no report has been received to date. Regular Council Meeting July 24, 1989 page 7 5. City Hall Building Improvements and Renovation: The Council was advised that it is the intent of the contractor for City Hall improvements to commence working on City Hall on or about July 26, 1989. b.
