2. Purpose of the Hearin9
To conduct a Public Improvement Hearing regarding reconstruction of various
roadways in conformance with Municipal State Aid Standards, and regarding
special assessment projects dealing with curb and gutter improvements, new
bituminous surfacing, replacement of certain water services from the water
main to the stop box, storm sewer replacements, resodding, and miscellaneous
associated construction items.
3. Presentation of Information by Staff
a. Project # 8716; Municipal State Aid Funding - Construction of 40th AVenue
from Hayes to Arthur Streets
The City Manager reviewed the project which will reconstruct 40th Avenue
consistent with Municipal State Aid Standards and will include installation
of new curb and gutter, driveway aprons, new bituminous surfacing, storm
sewer replacement, sodding and miscellaneous associated construction items.
It was noted that this section of 40th Avenue has never been reconstructed
and it is rapidly deteriorating. The resident at 1821 40th Avenue inquired
if the present stop signs will remain after the project is completed and
if consideration could be given to place utility lines underground. She was
advised that the stop signs will remain. Utility companies determine if
uti)ity lines will be put underground and the charges for this procedure
are made against the property'owners. The Public Works Director will pursue
this matter. It was noted that this roadway will be designed for nine ton
weight restrictions as are all state aid roads. It is not a local residential
street and it is not used that way.
Motion by Paterson, second by Paulson to authorize the staff to proceed with
Project #8716. Roll call: All ayes
b. Project #8717; Municipa) State Aid Funding - Construction of Seventh Street,
from 5)st to 53rd Avenues
As in Project #8716, no improvements on this project will be assessed to
property owners.
The City Manager reviewed the project and associated costs. The street will
be widened seven feet on both sides. Many residents objected to this seven
feet noting the difficulties which will be experienced with parking of cars,
retaining walls and steep inclines in driveways. Many of the residents felt
improving this street would increase the traffic and decrease the property
values. The City Manager noted that if the State Aid designation is removed
any Improvements in the future could be very costly for the property owners..
A petition opposing the improvement was presented to the City Council. The
City Manager suggested that the State Aid designation should be considered
for Washington Street, 51st to 53rd Avenues.
Motion by Petkoff, second by Paulson to deny proceeding with Project #8717
and to remove Seventh Street from State Aid designation. Roll call= All

c. Project #8718; Municipal State Aid Funding - Construction of 47th Avenue
from Tyler to Fillmore Streets

The City Manager reviewed the project and its costs. It was noted that no costs
will be assessed against the property owners as this is a State Aid project. The
fence located on the K-Mart property will ~ave to be moved.
Motion by Paulson, second by Peterson to authorize the staff to proceed with
Project #8718. Roll call: All ayes
d. Project #8723; Construction of Second Street from 40th to 42nd Avenues
The City Manager reviewed the project and its costs. He noted that a portion
of the project will be assessed to the townhouse/condominium project on 40th
and University Avenues. Since the assessments for individual owners in the
development will be minimal their assessment period was amended to one year
rather than the fifteen years assigned to the remainder of the project. This
arrangement will save approximately 25% of the administrative costs of the project.
Some of the affected residents felt the curbs and gutters did not need to be
replaced. The Public Works Director stated that if the street is resurfaced and
the damaged curbs and gutters are not replaced the integrity of the surface would
be compromised in a short time.
The City Manager noted that the residents had received hearing notices with esti-
mated costs for the project as follows: $74.10 street foot and $24.70 avenue foot.
These figures were revised as follows: $63.12 street foot and $21.04 avenue foot.
However, at the Public Hearing the City Manager provided corrected figures which
were as follows: $54.75 per street foot and $18.25 per ~venue foot.
The City Manager also explained the resolution which addressed the option of a
deferred assessment payment which is available for senior citizens.
Motion by Paulson, secondby Peterson to authorize staff to proceed with Project
#8723. Roll call: All ayes
e. Project #8724; Construction of 41st Avenue from 4th Street to Central Avenue
The City Manager reviewed the project and its costs. He noted that the costs
for the assessed property owners had been decreased from those included in their
hearing notices The estimated costs quoted in the hearing notices stated that
an avenue foot would be $16.45 and a street foot would be $49.35. The correct
costs are $15.55 per avenue foot and $46.65 per street foot. These decreases
resulted from the City contribution from the sewer and water funds. In response
to an inquiry, the City Manager advised that churches and City-owned property
in this assessment area pay the assessment as do individual property owners.
There was a lengthy discussion by residents and staff regarding this project.
Many of the residents suggested that the traffic on 41st Avenue comes from churches,
schools, and commercial businesses in the area and is not strictly residential
in nature. Staff was requested to do a traffic count. It was noted that the
traffic count would do nothing to change the fact that the street is substandard
and needs repair.
Council received material documenting those property owners who have been assessed
for the Fifth Street project as well as other projects in the area.
Motion by Petkoff, second by Hadtrath to authorize staff to proceed with Project
#8724. Roll call: Paulson, Petkoff, Peterson, Hadtrath - aye Carlson - abstain
4. Consideration of Resolutions Authorizing Pro~egts

BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights,
WHEREAS, the City Council of the City of Columbia Heights by motion on the
25th day of January, 1988 ordered notice of a hearing to be given to property
owners, and
WHEREAS, pursuant to a notice of hearing certain residents appeared at a
Council Meeting on the 7th day of March, 1988, and
WHEREAS, the Council determines to proceed with this local improvement
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is as follows:
Construction of 4Oth Avenue N.E., from Hayes Street to Arthur Street,
S.A.P. 113-1i2-04.
Funding to come from Municipal State Aid funds.
Work would include bituminous surfacing, new curb and gutter,
including driveway aprons, storm sewer replacement, resodding and
miscellaneous associated construction items. The proposed road is
45I from back of curb to back of curb.
2. That the materials to be used are as follows:
Aggregate base, bituminous surfacing, concrete curb and gutter, concrete
service walk and driveway aprons, sod, reinforced concrete storm sewer
pipe, concrete manholes and catch basins and various appurtenances.
That a careful estimate of the cost of the improvements has been made
by the City Engineer and the several lots and parcels of land fronting
upon and adjacent to such proposed improvements, which be deemed benefitted
thereby, were properly notified of said hearings, and
4. That the City Manager shall proceed with taking of bids for the
improvements, or portions of the improvements, as stated herein.
5. These improvements shall also be known as Project #8716.

Work would include new curb and gutter including driveway aprons, new
bituminous surfacing, replacing lead or galvanized pipe water services from
water main to stop box, storm sewer replacement, resodding and miscellaneous
associated construction items. The proposed road is 33' from back of curb
to back of curb (existing is 31').
2. That the materials to be used are as fo11.ows:
Aggregate base, bituminous surfacing, concrete curb and gutter, concrete
servicewalk and driveway aprons, sod, 6" ductile iron pipe, I" copper
water service pipe, reinforced concrete storm sewer pipe, concrete manholes
and catch basins and various apurtenances.
That a careful estimate of the cost of the Improvements has been made
by the City Manager and the several lots and parcels of.land fronting
upon and adjacent to such proposed improvements, which be deemed
benefited thereby, were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of the
severe4 parcels so improved as nearly as can be ascertained.
