The City Manager reviewed the consent agenda items.
Resolution No. 88-20; Resolution Amending Columbia Heights' Personnel
Policy Manual Holidays
The Council approved the following resolution:

AMENDING CITY OF COLUMBIA HEIGHTS' PERSONNEL POLICY MANUAL, SECTION 5(Il),
PARAGRAPH l, HOLIDAYS, OF THE CITY OF COLUMBIA HEIGHTS' PERSONNEL POLICY
MANUAL
BE IT HEREBY RESOLVED that the City of Columbia Heights' Personnel Policy
Manual, Section 5(11), Paragraph I, Holidays, be amended to read as follows:
Holidays include New Year's Day, Martin Luther King Day,
Presidents' Day, Good Friday, Memorial Day, Independence
Day, Labor Day, Veterans' Day, Thanksgiving Day, and Christmas
Day. In addition, employees not represented by an exclusive
representative (non-~3n) will receive the Day After Thanks-
giving and Christmas Eve Day as holidays. When Hew Year~.Day
Independence Day, Veterans' Day, or Christmas Day falls on
Sunday, the following day shall be a holiday. When New Year's
Day, Independence Day, Veterans' Day, or Christmas Day falls
on Saturday, the preceding day shall be a holiday. Christmas
Eve Day will be celebrated as a holiday on the regular work
day preceding the day on which Christmas Day is observed.

Request for Banner - Open House for All Pets Animal Hospital
The Council authorized the placement of a banner and sign in conjunction
with the Open House at All Pets Anima] Hospital, 5100 Central Avenue N.E.,
from March 22 - 26, 1988; and requested that a $100 refundable deposit
be provided to assure removal of the banner.
Award of Bid - Project #8601 - 1988 Watermain Replacem~.nt Project
The Council awarded Project #8'601 to F.M. Frattalone Excavating and Grading,
Inc. of St. Paul for their low total bid price of $63,170.97; and authorized

the Mayor and City Manager to enter into an agreement for same.
Gas Detection Meter to Comply with Confined Space Act
The Council authorized the purchase of one Exotox 40-OFH gas detection
meter from Davies Water Equipment Company for their Iow quotation of
$1,695 and authorized the Mayor and City Manager to enter into an
agreement for the same.
Purchase of Computer Equipment by Recreation and Community Services
The Council authorized the Recreation and Community Services Commission
to purchase three Apple Macintosh II computers, laser printer, connector
kits, and software at a cost of $16,O00 based on the Apple Education
Contract #570446 and authorized the Mayor and City Manager to execute
a contract for same.
The Council authorized the Recreation and Community Services Commission
request to transfer $4,740 from Printing Fund #250-45OOi-2030 ($4,000)
and Fund #255-45050-2030 ($740) to Fund #250-45OO1-5170 Office Equipment
and approved the Commission request of Sl,260 be appropriated from Rec-
reation and Community Services Fund - Fund Balance to Fund #250-45001-
5]70 Office Equipment.
It was noted that the Columbia Heights Athletic Boosters donated $10,OOO
toward these purchases.
Purchase of Sanafoam Vaporooter
The Council authorized the purchase of 135 gallons of Sanafoam Vaporooter
for a total of $6,804 from Davies Water Equipment Company, noting that this
is a proprietary item and authorized the Mayor and City Manager to enter into
an agreement with Davies Water Equipment Company for the purchase of same.
Purchase of Street Signs
The Council authorized the purchase of various street signs from Lyle Sign
Company of Eden Prairie, Minnesota for their low quotation of $1,412.12
under the Hennepin County Joint Purchasing Contract and authorized the
Mayor and City Manager to enter into an agreement for same.
Purchase of Replacement Doors for the Huset Block Garage Buildin~
The CoUncil authorized the purchase of three Midland CS-24 garage doors from
Twin City Garage Door for their iow quotation of $1,480 end authorized the
Mayor and City Manager to enter into an agreement for same.
Authorization to Purchase Line Paint for Park Department
The Council authorized the purchase of one Jaydee Model 4000 Line Painter
from Dalco Company of Minneapolis for thelr low quotation of $1,150 and
authorized the Mayor and City Manager to execute a purchase agreement for
same.
Training Sessions Regarding Introduction to Engineer Performance, Emission
Control and General Motors Computer Command Control System
The Council ratified the action of the City Manager in authorizing the
attendance of Tom Hosch at Engineer Performance, Control and Emissions
School conducted by the Genera] Motors Training Center from March 13 -
23, 1988.

Authorization to Sell, Salvage or Dispose of City Property
The Council authorized the sale, salvage, or disposal of surplus City
property (fixed assets) as indicated on the listing of surplus property
dated March 11, 1988.
Approval of License Applications
The Council approved the license applications as listed upon payment of
proper fees and waived the fees as indicated.
Payment of Bills
The Council approved payment of the bills as listed out of proper funds.
4. Approval of Consent Agenda
Motion by Peterson, second by Carlson to approve the consent agenda items
with the exception of approval of previous meeting minutes and removal of
the 1988 Police Budget Amendment item. Roll call: All ayes
4a. Minutes of Previous Meetings
Motion by Peterson, second by Petkoff to approve the minutes of the Regular
City Council Meeting of February 22, 1988 as presented in writing and that
approval of the minutes of the March 7th Public Improvement Hearing be pre-
sented for approval at the March 28th Regular City Council Meeting. Roll
call: All ayes
5. Proclamations
Mayor Hadtrath read a proclamation designating March 13 20, 1988 as Camp
Fire Birthday Week in Columbia Heights. He presented the proclamation to
members of the Camp Fire Girls who were accompanied by their mothers and
leaders.
5a. Open Mike
A number of residents who would be assessed for the 41st Avenue project
stated they did not realize this project would affect them as they did
not live on 41st Avenue. They did not attend the Public Improvement Hearing
where this project was discussed. Some of the residents stated they did
not feel the entire street required repair nor curb and gutter replacement.
One of the residents who lives on Fifth Street advised the Council that
this assessment will be the fourth one she will be paying on this year. The
City Manager noted that two of her assessments will be paid in full this
year. Some of the residents requested that another hearing on this project
be scheduled. The City Manager stated that hearing notices are sent only
to those property owners who will be assessed for a project. Many of the
residents in attendance had received the notice but did not know that the
project assessments would apply to their property.
Mayor Hadtrath noted that this matter will be discussed by the Council at
a future work session. The City Manager advised that all property owners who
received notices of the hearing will be advised by letter of the Council's
findings at its work session.
6. Ordinances and Resolutions
a. Resolution No. 88-21; A Resolution in Favor of Municipal Zoning Authority

RESOLUTION NO. 88-21
A RESOLUTION IN FAVOR OF MUNICIPAL ZONING AUTHORITY IN THE MATTER OF THE
LOCATION OF LICENSED RESIDENTIAL PROGRAMS (GROUP HOMES) UNDER MINNESOTA
STATUTES 1987 SUPPLEMENT, SECTION 245A.11, SUBDIVISION 3, AND IN OPPOSITION
TO CHANGES PROPOSED BY S.F. NO. 1626 AND H.F. NO. 2154
WHEREAS, the State of Minnesota is a leader in the area of community based
treatment for individuals through licensed residential programs (Group
Homes); and,
WHEREAS, a licensed residential program has the greatest chance of success if
there is a cooperative effort among the agency directing the program, local
residents in the neighborhood, and municipal government officials; and,
WHEREAS, local government zoning authority through the process of special
use permit or a conditional use permit has heretofore been recognized in
the law as a means of assuring proper maintenance and operation of a licensed
residential program; and,
WHEREAS, the use of local zoning authority through the process of a special
use permit hearing or a conditional use permit hearing provides a conduit for
community information and comment and ultimately contributes to the under-
standing of licensed residential programs; and,
WHEREAS, S.F. No. 1626 and H.F. No. 2154 would eliminate the requirement of a
special use permit or a conditional use permit in multi-family residential
areas for a licensed residential program with a licensed capacity of seven
(7) to sixteen (16) adults;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLUMBIA
HEIGHTS that the City Council expresses its opposition to the changes pro-
posed in S.F. No. 1626 and H.F. No. 2154; and, furthermore, declares its
support to continue and maintain the zoning authority as currently provided
in Minnesota Statutes 1987 Supplement, Section 245A.11, Subdivision 3.

b. First Reading of Ordinance No. ll60, Being an Ordinance Amending
Ordinance No. 853, City Code of 1977, Pertaining to Authorization of
Persons Other Than Peace Officers to Issue Tags for Certain Violations
Motion by Carlson, second by Peterson to waive the reading of the ordinance
there being ample copies available to the public. Roll call: All ayes
Councilmember Petkoff inquired as to the costs for training other City
staff to perform the duties being authorized by this ordinance. The City
Attorney responded he felt the training may not take much more than two
hours.

BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING
TO AUTHORIZATION OF PERSONS OTHER THAN PEACE OFFICERS TO ISSUE TAGS FOR CERTAIN
VIOLATIONS OF LAW
The City of Columbia Heights does ordain:
Section 1:
Section 3.203(7) of the City Code of 1977, passed June 21, 1977,
which is currently reserved shall hereafter read as follows,

7. Communications
a. Planning and Zoning Commission
Columbia Heights Community Credit Union - Variance
This variance is being requested so there can be angle parking for the Credit
Union. Discussion followed regarding the screening fence which will be on the
north side of the parking lot.
Motion by Peterson, second by Petkoff to.grant a twenty (20) foot landscape
area variance along the north property line to the Columbia Heights Community
Credit Union located at 843 40th Avenue due to the narrowness of the lot and
that the fence in the deck area of the neighbor on the north be elevated to
eight (8) feet and be made aesthetically pleasing.-~O~~

b. Traffic Commission
No Parking on the South Side of 40th Avenue Between Van Buren Street and Central
Avenue
Motion by Carlson, second by Peterson to restrict parking on the south side
of 40th Avenue N.E. from Van Buren Street to Central Avenue to "No Parking
Anytime" except for an area beginning 50' west of the face of the curb on
Central Avenue and extending 60' to the west.
Councilmember Petkoff felt leaving spaces for some cars to park in this area
would be a safety hazard and that the municipal parking lot and the ramp are
close enough to accommodate any cars. Roll call: Carlson, Paterson, Hadtrath -
aye Petkoff - nay
8. New Business
a. 1988 Police Budget Amendment
Motion by Paterson, second by Carlson to amend the Police Department Budget by
eliminating the part-time clerk-typist positions and creating a full-time
position. Roll call: All ayes
b. Lead Notification
Motion by Petkoff, secodd by Peterson to authorize the purchase of 8,500
A.W.W.A lead bill stuffers for a total amount of $1,105; and, that the Mayor
and City Manager be authorized to enter into a contract for same; and, further-
more, that $1,105 be appropriated from the Water Utility Fund Retained Earnings
to Account 601-49440-2030. Roll call: All ayes
c. Offer to Purchase City-Held property at 1309 44½ Avenue
Motion by Peterson, second by Carlson to table this matter until an appraisal
has been received. Roll call: All ayes
d. Establish Date for Work Session
The Council scheduled a work session for Wednesday, March 23rd at 7:00 p.m.
Reports
a. Report of the City Manager
The City Manager's report was submitted in written form and the following
items were discussed:

Location of Bicentennial Monument: This item will be on a work session
agenda.
Request of Cable TV North Central to Meet in a Work Session With City
Council: The City Manager reviewed what he had recommended to the Cable
TV staff
Liquor Store #2, Alternative Uses: The City Manager noted that there is
a party interested in buying the facility. He will have a report or recom-
mendation for the Counci) at the March 28th meeting.
b. Report of the City Attorney
The City Attorney noted he had received another proposal regarding the parking
ramp but does not recommend it.
The City Attorney stated the property owner of 3721 Hayes Street has been located.
10. Request for License Fee Refund
The Counci) received a letter from John Zaccardi, owner of Dave's Bar located
at 4952 Central Avenue, requesting full or partial refund for the 1988 licenses
he has purchased.
Discussion fo)lowed regarding the past practice and policy of the Council on
license refunds.
The City Attorney requested that the refund decision be put in the form of e
resolution.
Motion by Petkoff, second by Paterson to waive the reading of the resolution
there being ample copies available to the public. Roll call: All ayes
RESOLUTION NO. 88-22
AUTHORIZING PARTIAL REFUND OF 1988 LICENSES
WHEREAS:
At its Regular Council Meeting of March 14, 1988, the City
Council did review the request of John Zaccardi for a full
or partial refund of the 1988 licenses purchased for Dave's
Bar located at 4952 Central Avenue N.E., and,
WHEREAS:
WHEREAS:
Section 5.103(5) of the License Section of the City Ordinance
states "Fees shall not be prorated unless specifically authori-
zed herein, or by Council resolution, and are not refundable
for any reason, including license revocation, suspension or
termination of the licensed activity", and,
Past practice was, if the license holder discontinued oPeration
before June 30th of the license year, one half (½) of the
On-Sale Beer License fee would be refunded only ( an On-Sale
Beer License is $300.00).
NOW, THEREFORE, BE IT RESOLVED, that the City Council authorizes the refund
of $150.00 to John Zaccardi, owner of Dave's Bar at 4952
Central Avenue N.E.
