PUBLIC IMPROVEMENT HEARING
MARCH 21, 1988
The Hearing was called to order by Mayor Nadtrath at 7:30 p.m..
1. Roll Call
Paulson, Petkoff, Carlson, Peterson, Hadtrath - present
2. Purpose of the Meeting
To conduct a Public Improvement Nearing regarding special assessment projects.
Introduction of Staff
The City Manager introduced the City Engineer/Public Works Director, the Assistant
City Engineer and the Assessing Clerk.
3. Presentation of Information by Staff
a. Project #8726 - PIR 830; Construction of 41st Avenue from Reservoir
Boulevard to Stinson Boulevard
The City Manager reviewed the project and the estimated costs. He noted that
an additional cost has been added to this project since it was last considered
at a hearing, that being a pond construction cost. This item is required by
the Rice Creek Watershed District.
Questions and Answers
The property owner of 1814 41st Avenue inquired if it compulsory that water
service be installed on his vacant lot. He noted he has no intention to build on
or improve the lot. He was advised that this is not a compulsory requirement
but no installation will be allowed within the next five years which is a
policy of the Council.
Some residents expressed concern that heavy trucks may be using 41st Avenue
for the construction at the First Lutheran Church. The church representatives
stated that an agreement with the contractor stipulates that trucks will use
only 40th Avenue and Polk Street to gain access and have egress from the
property.
The City Manager reviewed the formula used for determining street and avenue
assessments and he noted that if a project bid comes in over 10% of the esti-
mated costs that another hearing will be called or the project will not be
done and a rebid will be requested.
The City Engineer advised residents that no assessments are made to properties
located on State Aid streets because the City receives funding from the State.
This funding takes into consideration the increased vehicular travel on the
streets as well as the associated noise and inconvenience.
The costs on this project have increased approximately 14% since it was last
considered at a hearing.
Motion by Peterson, second by Paulson to authorize staff to proceed with
Project #8726. Roll call: All ayes
b. Project #8727 - PIR 832 - Overlay/Construction of 39th Avenue from Arthur
Street to McKinley Street and Construction of Cleveland Street to McKinley
Street
The City Manager reviewed the projects and the associated costs.

c. Project #8800 - PIR 826; Sealcoating of streets in the southwest quadrant
of the City
The City Manager reviewed the project and its estimated costs. He noted that
sealcoating does not improve the strength of the street but rather improves
the surface. This observation was made in response to some of the residents'
questions regarding the condition of their various streets.
The City Manager distributed a map to the Council which detailed those streets
in this quadrant which are not being sealcoated.
Discussion followed regarding some cracking which has been experienced on Fifth
Street. The Public Works Director stated that uniform cracking of street sur-
faces always occurs generally after about three years and that this is caused
by expansion and contraction.
The resident at 4042 Monroe Street identified the streets that she and some
of her neighbors want removed from the sealcoat project. She stated that
these streets are included in the five year capital improvement plan and
feels sealcoating should not be done if the streets are going to be re-
constructed in the next three years. She presented the Council with petitions
opposing the sealcoating on given streets.
The City Manager felt it was doubtful that the-streets would all be reconstructed
within the next three years and noted that the five year capital improvement
was a plan and not a guaranteed course of action.
Councilmember Paulson noticed that the wording on the petitions led the reader
to conclude that the reconstruction of the streets in the capital improvement
plan would be happening in the very near future, probably one or two years~
and that this was not factual.
Councilmember Petkoff felt that property owners should be reimbursed for their
sealcoating assessment if any of these streets were reconstructed within the
next two years.
Motion by Petkoff, ~econd by Paulson to proceed with the sealcoating project
and if any of those streets noted on the capital improvement plan receive
major construction within the next two years that the property owners be
rebated the cost of the sealcoating assessment. Roll call: Paulson, Petkoff,-

d. Project #8802 - PIR 828; Joint and crack sealing in concrete alleys
The City Manager reviewed the project and the estimated costs. Five petitions
were received in opposition to the crack sealing in the following alleys:
5th Street - Sixth Street, 49th to 50th Avenues
4th Street - Fifth Street, 48th to 49th Avenues
6th Street - Seventh Street, 48th to 49th Avenues
Main Street - Second Street, 44th to 45th Avenues
4th Street - Fifth Street, 44th to 45th Avenues
The Public Works Director explained that these alleys are having the joint
and crack sealing work done to preserve them. He noted that when water and
sand get beneath the alley surface the alleys will crack and become badly
damaged.
Councilmember Petkoff noted that it would have been helpful if the staff
had prepared videos of these alleys so knowledgeable responses could be
made to those residents who felt their alleys did not need the work done.
Motion by Petkoff, second by Carlson to authorize the staff to proceed with
the project except on those alleys where petitions have been submitted.
Councilmember Paulson felt he could not support eliminating those alleys

based only on the submitted petitions. He noted that the Council had no
way to determine if these petitions reflected the feelings of more than
50% of the affected property owners.

e. Project #8802 - PIR 840; Miscellaneous surface repairs on certain concrete
alleys and joint and crack sealing on certain concrete alleys
A petition was presented for the deletion of the crack and joint sealing project
on the concrete alley, Quincy Street to Jackson Street, 42nd to 43rd Avenues.
The presenter noted that all property owners but one had signed the petition.
A similar petition was received in opposition to that portion of the project
which addressed the concrete alley located between Main Street and Second
Street, 42nd to 43rd Avenues. The presenter stated that all of the affected
property owners signed the petition.
Motion by Carlson, second by Hadtrath to deny the project which addressed
joint and crack sealing of the concrete alleys in the following areas: Main Street to Second Street, 42nd to 43rd Avenues
Quincy Street to Jacksin Street, 42nd to 43rd Avenues and
Sixth Street to Seventh Street, 50th to 51st Avenues
Roll call: Petkoff, Carlson, Hadtrath - aye Paulson, Peterson- abstain
Councilmembers Paulson and Peterson could not support the motion based on
the petitions received as they did not have the actual verification that 50%
of the affected property owners had signed the petitions.
Motion by Paulson, second by Petkoff to approve the surface repair project
for the following concrete alleys:
Fifth Street to Sixth Street, 42nd to 43rd Avenues
Van Buren Street to Central Avenue, 44th to 45th Avenues
Fairway Drive to Highland Place to West Upland Crest at East Upland Crest

Councilmember Petkoff requested that staff review the hearing notices and the
attached material. She felt the information presented in the notices and the
attachments could be made clearer so those who receive them could be better
informed as to what is actually being done and what the estimated costs would
be.
Councilmember Paulson requested that staff include in improvement hearing
material for the Council the number of property owners who would be affected
by each project.
4. Consideration of Resolutions Authorizing Projec.ts

WHEREAS, the Council determines to proceed with this local improvement, a portion
of the cost being defrayed by special assessments under Charter provisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is as follows:
Construction of 41st Avenue N.E., from Reservoir Boulevard to Stinson Boulevard.
Work includes a new curb and gutter including driveway aprons, new aggregate
base, new bituminous surfacing, replacing lead or galvanized pipe water
services from watermain to stopbox, storm sewer improvements, resoddinQ and
miscellaneous associated construction items. The roadway width will remain
the same.
2. That the materials to be used are as follows:
Aggregate base, bituminous surfacing, concrete curb and gutter, concrete
servicewalk and driveway aprons, sod, 6" ductile iron pipe, 1" copper water
service pipe, 4" cast iron sewer pipe, reinforced concrete storm sewer pipe,
concrete manholes and catch basins and various apurtenances.
3. That a careful estimate of the cost of the improvements has been made by the
City Manager and the several lots and parcels of land fronting upon and
adjacent to such proposed improvements, which be deemed benefitted thereby,
were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of the several
parcels so improved as nearly as can be ascertained.
5. That the City Manager shall proceed with taking of bids for the improvements,
or portions of the improvements as stated herein.
6. These improvements shall also be known .as P.I.R. #830 - Project #8726.

by the City Manager and the several lots and parcels of land fronting
upon and adjacent to such proposed improvements, which be deemed
benefitted thereby, were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of the
several parcels so improved as nearly as can be ascertained.
5. That the City Manager shall proceed with taking of bids for the
improvements, or portions of the improvements as stated herein.
6. These improvements shall also be known as P.I.R. #832 - Project 8727.

25th day of January, 1988 ordered notice of a hearing to be given to
property owners, and
WHEREAS, pursuant to a notice of hearing certain residents appeared at a
Council Meeting on the 21st day of March, 1988, and
WHEREAS, the Council determines to proceed with this local improvement, a
portion of the cost being defrayed by special assessments under Charter
provisions.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is as follows:
Sealcoating of all bituminous streets in the Southwest Quadrant of the
City (area II) or that part bounded by 37th Avenue N.E. on the south,
California and Main Streets N.E. on the west, 44th Avenue N.E. on the
north and Central Avenue on the east.
Work includes selective concrete curb and gutter repairs, bituminous
surface patching and sealcoating.
2. That the materials to be used are as follows:
Miscellaneous concrete curb repair, bituminous patching asphalt
emulsion and sealcoat aggregate.
3. That a careful estimate of the cost of the improvements has been made
by the City Manager and the several lots and parcels of land fronting
upon and adjacent to such proposed improvements, which be deemed
benefitted thereby, were properly notified of said hearings, and
4. That the City Manager shall also list the names and owners of the
several parcels so improved as nearly as.can be ascertained, however,
if the following streets are reconstructed within two years from the
date of this hearing, credit will be given for the cost of this seal
coat: 4th St., 40th Ave. - 42nd Ave.; 6th St., 40th Ave. - 45th Ave.;
7th St., 4Oth to 44th Ave.; Washington St., 40th Ave. - 43rd Ave,;
Madison St., 4Oth Ave. - 44th Ave.; Monroe St., 40th Ave. - 41st Ave.;
Quincy St., 4Oth Ave. - 43rd Ave.; and Van Buren St., 40th Ave. -
41st Ave.
5. That the City Manager shall proceed with taking of bids for the improvements

6th and 7th Streets on the 4800 block, Columbia Heights, do hereby vigorously
protest the proposed repair to said alley. As in the past, we have examined the
alley and found no deterioration needing repair.
