Consent Agenda The following items were on the consent agenda: Minutes for Approval The Council approved the minutes of the Regular City Council Meeting of Novem- ber 14th as presented and there were no corrections. Resolution No. 88-78; Establishing Senior Citizen Eligibility Standards for Refuse, Sewage Disposal and Water Supply Utility Rates The reading of the resolution was waived. RESOLUTION NO. 88-78 ESTABLISHING SENIOR CITIZEN ELIGIBILITY STANDARDS FOR REFUSE, SEWAGE DISPOSAL AND WATER SUPPLY UTILITY RATES WHEREAS, the City Council has previously established eligibility standards for senior citizens for Refuse Service, Disposal, and Water Supply; and WHEREAS, it has been the City's practice to maintain uniform eligibility standards whenever possible; NOW, THEREFORE, BE IT RESOLVED by the City of Columbia Heights as follows: 1. That anyone over 62 years of age with a maximum household income of $11,300 will be eligible for reduced rates. BE IT FURTHER RESOLVED that the above eligibility standard to be effective January l, ~989. Passed this 28th day of November, 1988. Hadtrath do-Anne Student, Council Secretary Handicap Parking Stall The Council authorized the installation of one handicap parking stall in front of 4904 Sixth Street based on the recommendation of the Traffic Commission. Holiday Advertising at Top Valu The Council authorized the Mayor and City Manager to enter into an agreement Regular Council Meeting November 28, 1988 page 2 with the Star and Tribune for three, one-day advertisements of liquor store merchandise at a cost not to exceed $4,100. Request for Midblock Lighting Hearing The Council received the petition concerning midblock lighting on East Upland Crest between Highland Place and Forest Drive and established January 9, 1989 at 7:30 p.m. as the time and date for an assessment hearing. Establishing Date for Public Hearing for Light Rail Transit The Council authorized a public hearing regarding Light Ra~! Transit Corridors on December 12, 1988 as part of the Regular City Council Agenda. Final Payment for Municipal Project #8601 The Council accepted the work for Municipal Project #8601 and authorized final payment of $5,722.66 to F.M. Frattalone. This project was for a watermian re- placement. New Data Processing Equipment The Council authorized the Mayor and City Manager to enter into an agreement with Business Records to purchase data processing hardware and license software at a cost not to exceed $43,720. Licenses The Council approved the 1988 and 1989 license applications as listed upon payment of proper fees. Payment of Bills The Council authorized the payment of bills as listed out of proper funds. 4. Approval of Consent Agenda Motion by Carlson, second by Peterson to adopt the consent agenda as presented. Roll call: All ayes 5. Open Mike There were no residents present for Open Mike. 6. Ordinances and Resolutions Second Reading of Ordinance No. 1175; Being an Ordinance Amending Chapter 4, Section 28A, of the Charter of the City of Columbia Heights Pertaining to Primary Elections Motion by Paulson, second by Petkoff to waive the reading of the resolution there being ample copies available to the public. Roll call: All ayes ORDINANCE NO. 1175 BEING AN ORDINANCE AMENDING CHAPTER 4, SECTION 28A, OF THE CHARTER OF THE CITY OF COLUMBIA HEIGHTS PERTAINING TO PRIMARY ELECTIONS The City of Columbia Heights does ordain: Section l: Chapter 4, Section 28A, of the Charter of the City of Columbia Heights which reads as follows, to-wit: Regular Council Meeting November 28, 1988 page 3 Section 28A. THE PRIMARY ELECTION. A primary municipal election shall be held twenty-one days before the regular municipal election in the year 1933 and bi- ennually thereafter at the same place or places as general elections are held and like officers shall be to select candidates to be voted for at the general municipal election and the candidates for nomincation to each office who shall receive the greatest number of votes in such primary election shall be placed upon the ballot of the next general election ~n numbers not to exceed double th& number of vacancies to be filled, and no other name shall be placed upon the ballot for such general election than the candidates selected at said primary election. Any person desiring to become a candidate for an elective office in the general municipal election shall file with the city clerk at least' twenty- one days prior to said primary election a statement of such candidacy as follows: I, ---, being first duly sworn, say that I reside at --- Street in the City of Columbia Heights, County of Anoka, State of Minnesota; That I am a qualified voter therein; That I am a candidate for nomination to the office of --- to be voted upon at the primary election on --- the --- day of ---, 19---; and I hereby request that my name be printed upon the official primary election of said office. Signed Subscribed and sworn to before me this --- day of ---, 19---. Signed Official Title and shall pay to the City Clerk the sum of Five Dollars for which the City Clerk shall give a receipt expressing the purpose of the payment. Such City Clerk shall forthwith pay all fees so received to the City Treasurer. Upon compliance with the provisions of this section the City Clerk shall place such name upon the primary election ballot as a candidate for the office named. At least fifteen days notice shall be given by the City Clerk of the time and place of holding such primary election and of the officers to be nominated, by posting a notice thereof in at least three of the most public places in each election district in the city or by publication of a notice thereof at least one in the official newspaper, or both, as the City Council may ordain, but failure to give such notice shall not invalidate such election. Is herewith amended to read as follows, to-wit: Section 28A. THE PRIMARY ELECTION. When no more than twice the number of individuals to be elected to a municipal office file for nomination for the office, their names shall not be placed upon the primary ballot and shall be placed upon the municipal general election ballot as the nominees for that office. When not more than twice the number of individuals to be elected to a municipal office file for nomination to any Regular Council Meeting November 28, 1988 page 4 municipal office, no primary shall be held, and the names of those having filed shall be placed on the municipal general election ballot as the nominee for that office. Communications Excavation of 42nd Avenue by U.S. West Communications Company The Public Works Director explained why this excavation is necessary to accommodate the utility needs of the residents. Councilmember Carlson noted that this street had recently been reconstructed and this request should have'been made before the reconstruction was completed. Councilmember Paulson inquired if the City would have any recourse if the street repair done after the excavation were not done correctly. The Public Works Director advised that the City has an on-going bond on all of the utility companies. Regular Council Meeting November 28, 1988 page 5 Motion by Carlson, second by Peterson to allow U.S. West Communications Company to excavate a 1 foot by 1 foot gas main locating hole on 42nd Avenue prior to boring the street for an underground service in order to provide for the public safety. Roll call: All ayes 8. 01d Business a. Excise Tax and License Fees for Vehicle Purchased February 22, 1988 Motion by Petkoff, second by Peterson to authorize the expenditure of $1,280.09 for excise tax and licensing fees for Municipal Unit #199; and furthermore, to authorize the Mayor and City Manager to execute an~ agreement for the same. Roll call: All ayes b. Abandonment of Project #8803 - Huset Park Improvements Alternatives for action were presented to the Council on this matter. Staff indicated to the City Manager they feel there is still a need for added baseball diamonds at Huset Park. Discussion followed regarding how members of the Council felt about proceeding with an election. Some members of the Council felt the residents should vote on the project. Motion by Hadtrath to set a date for a special election. The City Attorney advised that the petition must be addressed first. Motion by Hadtrath to deny the petition and pass the ordinance denying Project #8803. The City Attorney advised that the issue is a moot point at this time. Bruce Nawrocki, one of the ci'rculators of the Initiative Petition, read a letter from all of the circulators. The letter stated that the petitioners will accept the action of the Council on October lOth whereby the project was abandoned. He then stated that the petition was withdrawn. The City Manager advised that no further action of the Council was needed. Mayor Hadtrath requested that a committee be established made up of repre- sentatives of civic organizations and from each precinct to deal with the issue of Huset Park. He felt a committee of this type would make for good communication as to what is being discussed and being done about Huset Park. Councilmember Paulson felt a special election would have been an excellent way to deal with the issue, but the Council is dealing with the most impor- tant issue at the time, that being one of hazardous waste. c. Bids and Specifications for Electrical and Mechanical Work at Municipal Service Center, Library, and City Hall, Including Roofing at City Hall. The City Manager requested that this matter be discussed at the Special Council Meeting on.November 3Oth. 9. New Business a. Amendments to Snow Removal Plan This item will be discussed at the Special Council Meeting on November 3Oth. b. Payment for Repair of Street Lights System on Central Avenue Motion by Peterson, second by Carlson to authorize payment of $1,313.74 to Bacon Electric Company of Fridley for the repair of the City street light system. Roll call: All ayes c. Final Payment for Bus Repainting Motion by Petkoff, second by Peterson to authorize payment of $2,686.17 Regular Council Meeting November 28, 1988 page 6 to the Metropolitan Transit Commission for body and~paint work on the city bus. Roll call: All ayes d. Engagement Letter for 1988 Audit The Finance Director's agenda letter noted that proposals for auditing firms should be sent out in August or September and the preliminary audit should start in December. Noting this, Councilmember Petkoff requested that this proposal be brought to the Council much earlier in the future. Motion by Carlson, second by Peterson to enter into an engagement letter with Bergren, Holmgren, and £oberg, L.T.D. to complete the City's 1988 Audit at a fee not to exceed $12,500. Roll call: All ayes 3. Light Rail Transit Councilmember Paulson requested this matter be formally discussed with staff and a public hearing be scheduled on this item for the community. Motion by Paulson, second by Hadtrath to direct the City Manager to research and set up a meeting with the City Council to determine the impact of Light Rail Transit in other communities as well as some cost figures. Roll call: All ayes The method for plowing walkways in City parks was discussed. f. Ordinance No. 1177; Being an Ordinance Authorizing the Sale of 322 40th Avenue Copies of Ordinance No. 1177 were distributed to the Council. Mayor Hadtrath stated he was hesitant to take action on this ordinance since the Council did not have ~ime to review it. The City Manager advised that a first reading could be held and re- visions could be made before the second reading'. Mayor Hadtrath requested that this be an agenda item for the November 30th Special Council Meeting.. 10. Reports a. Report of the City Manager The City Manager's report was submitted in written form and the following items were discussed: 1. 1989 Contract Demands From Teamsters Local 320 - Police Officers and Sergeants: This item will be discussed at a future Council work session. 2. Wargo Court Reconstruction: It was noted that some of the funding for this reconstruction will be from the developer of the project adjacent to Wargo Court. 3. Development on 49th and Central Avenues: This development was discussed regarding the tenants. b. Report of the City Attorney The City Attorney advised the Council that the revisions of the Housing Code have been completed and are available.
