COLUMBIA HEIGHTS CITY COUNCIL
PUBLIC IMPROVEMENT HEARING
MARCH 16, 1987
The hearing was called to order by Mayor Nawrocki at 7:30 p.m..
1. Roll Call
Paulson, Petkoff, Carlson, Petkoff, Nawrocki - present
2. Purpose of the Hearing
To conduct a Public Improvement Hearing regarding special assessment projects
dealing with watermain replacement, alley construction, sealcoating of bituminous
streets in the northwest quadrant of the City, and joint and crack sealing in
various concrete alleys.
Mayor Nawrocki advised those in attendance that if the bids received are more than
10% of the estimates the hearing will be reopened. He noted that next fall all of
the assessments would be tabulated and an assessment hearing will be held. The
Mayor explained the payment procedure and advised that the 11% interest rate will
be reviewed by the Council. It was noted that 44th and 49th Avenues will not be
sealcoated as they are County State Aid streets and the County had not budgeted
for this work.
3. Presentation of information by Staff
The Mayor introduced the City Manager, City Engineer, Assistant City Engineer, and
the Assessment Clerk.
a. PIR #815 - Project 8703
Project 8703 is sealcoating of all bituminous streets in the northwest quadrant
of the City.
The City Manager reviewed the project and its costs. The charging of costs to
cities abutting this project were discussed. The costs specifically were for
administrative and engineering costs.
The resident at 5229 Washington Street inquired if hea~y equipment trucks would
be using Washington Street for development of Sullivan Lake housing. He felt the
property owners on this street should not be assessed for this project if these
trucks would be using the street and probably undermine the work. He was advised
it is the hope of the Council that the trucks would be using 53rd Avenue. The
Mayor advised him this matter would be a subject of the project. The resident
at 5240 Washington Street felt the entire street should be deleted from the project.
Mayor Nawrocki noted that if the development of housing at Sullivan Lake proceeds
there will be a public hearing and this matter will be considered at that hearing.
In response to a question regarding curb repair the Mayor explained that the cost
for this repair is spread over the entire project.
b. PIR #818 - Project 8702
Project 8702 is construction of the alley between Reservoir Boulevard and Tyler
Street, 'south of 43rd Avenue
The City Manager reviewed the project and the costs.
Mayor Nawrockl inquired why the engineering costs are so high on this project.
The City Manager explained that costs to prepare any project are basically the
same. But in a smaller project such as this there are fewer parcels to assess.
Fred Salsbury, Public Works Director, advised the Council that much time was spent
on locating the irons indicating the property corners and there was considerable
surveying time spent.
A petition was received by the Council which was signed by the majority of the
property owners on this alley ~ndlcatlng their opposition to the project. The
project was not authorized.

c. PlA #819 -. Project 8701
Construction o~ alley between University Avenue and 4th Street, from 47th to
48th Avenues
The City Manager reviewed the project and costs.
This alley project was proposed in response to a request from property owner who
stated that part of the alley is on his property. This owner was present at the
hearing and:submitted photos to the Council showing how his property is being
used by vehicles driving in the alley. He has placed stakes at the edge of his
lot. The Public Works Director agreed-that the alley is on the lot and it would
have to be moved to the west and graded.
A petition was received signed by eighteen of the twenty-five property owners
opposing the project. Mayor Nawrocki acknowledged the petition but stated that
the correction must be made. He requested staff to get estimates for this cor-
rection and grading. One resident fe)t the City should pay t,he costs for main-
taining the alley. The Mayor said that for the City to maintain something there
must be something for it to maintain. He noted that there has never been a surface
on this alley.
Motion by Petkoff, second by Paulson to continue the hearing on Project 8701 until
the March 23rd Council meeting. Roll call: All ayes
d. PlA #820 - Project 8700
Construction of alley between Third Street and Trunk Highway 47 from 44th to 45th
Avenues
The City Manager reviewed the project and costs.
A petition was received in opposition of the project from those owners of 64% of
the footage on the alley. The circulator of the petition felt.this alley was
.acceptable and had received good maintenance and was very well plowed in the winter.
The resident at 4429 Third Street expressed a concern with an on-going problem
she is experiencing with water in her garage. She noted that the foundation has
been affected and felt the location of the catch basin was the cause. The Public
Works Director felt relocating the catch basin may alleviate the problem. The
project was not approved by the Council.
Motion by Petkoff, second by Paulson to direct the City Manager to gather Informa-
tion regarding the relocation of the catch basin and bring this information to
the March 23rd Council meeting. Roll call: All ayes
e. PlA #823 - Project 8601
Watermain replacement and atley reconstruction north of 46th Avenue at Parkview
Lane
The City Manager. reviewed the project and the costs. There were two alternatives
proposed for the alley surface, concrete and bituminous.
This area was developed over a landfill and the alley and water service was put
in by the developer. Settling of the land accounts for the frequent.watermain
breaks which in turn damages the surface of the alley. A letter was received from
property owners in this area stating the entire project should be paid by the
City. The Mayor advised those in attendance that n~uch discussion was had regarding
this project and the Council will be paying half of the costs of the concrete sur-
face of the alley. Property owners expressed a preference for a concrete surface
which is what is on the alley at the present time. The majority of the Council
support the use of concrete for this project.
f. PIR #824 - Project 8708 ~,
Joint and crack sealing to include routing of a11 cracks, cleaning of ali joints
and sandblasting and sealing of all joints and cracks in certain concrete alleys
Two petitions were received in opposition to the following alley projects:

Main Street, 2nd Street, q2nd to q3rd Avenues and Quincy Street, Jackson Street,
q2nd to q3rd Avenues.
There was a !engthy discussion regarding payment procedures. The Council was polled
regarding the deletlon of the alleys addressed in the petitions received. The alley
between Main and Second Streets, q2nd to h3rd Avenues project was opposed by ali
of the affected property owners. A spokesman.for this alley felt this was a make work
project and that the alley was in acceptable condition. Mayor Nawrocki responded that
this is clearly not a make work project but a needed maintenance project. He relies
on the information the Council receives from the Public Works Oepartment regarding
which alleys need repair. He noted that while it is not popular to go ahead with
this type of project i[ is responsible. He suggested that if the project were not
done there would be complaints a few years from now from the residents about the
deteriorating condition of their alley and it would be more costly.

RESOLUTION NO. 87-20
BEING A RESOLUTION ORDERING IMPROVEMENTS
BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights,
WHEREAS, the City Council of the City of Columbia Heights by motion on the 12th day
of January, 1987 ordered notice of a hearing to be given to property owners, and
WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council
Meeting on the 16th day of March, 1987, and
WHEREAS, the Council determines to proceed with this local improvement, a portion
of the cost being defrayed by special assessments under Charter provisions,
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is as follows:
Seal coating of all bituminous streets in the Northwest Quadrant of the City
(Area 1) or that part bounded by hqth Avenue N.E. on the South; Central Avenue
N.E. and the Corporate Limit with the City of Hilltop on the East; 53rd Avenue
N.E. on the North; and Main Street N.E., hqth Avenue N.E. to qSth Avenue N.E,
and University Avenue N.E., qSth to 53rd Avenues N.E. on the West.
Work would include miscellaneous concrete curb and gutter repairs, as well as
bl'tuminous surface patching prior to seal coating.
2. That the materials to be used are as follows:
Miscellaneous concrete curb repair, bituminous patching, asphalt emulsion
and seal coat aggregate.

3. that a carefut estimate of the cost of the improvements has been ma~e by the
City Manager and the several lots and parcels of land fronting upon and adjacent
to such proposed improvements, which be deemed benefited thereby, were properly
notified of said hearings, and
That the City Manager shall also list the names and owners of the several parcels
so improved as nearly as can be ascertained.
That the City Manager shall proceed with taking of bids for the improvements,
or portions of the improvements as stated herein.
6. These improvements shall also be known as P.I.R. #815 - Project.#8703.

WHEREAS, the Council determines to proceed with this local .improvement, a portion
of the cost being defrayed by special assessments under Charter provisions,
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. That the location and extent of such improvements is as follows:
Watermain replacement and alley reconstruction north of 46th Avenue N.E. at
Parkview Lane.
Work would include laying.new ductile iron watermain, with insulation, recon-
nection of existing copper water services, replacement of existing concrete
alley surface with new concrete alley and miscellaneous associated construction
items.

2. That the materials to be used are as follows:
Aggregate base, filter fabric, concrete alley surfacing, concrete alley aprons,
driveway repairs, sod; ductile iron watermaln with polywrap and insulation,
copper water services and various appurtenances; and reinforced concrete catch
basin.
3. That a careful estimate of the cost of the improvements has been made by the
City Manager and the several lots and parce]s of land fronting upon and adja-
cent to such proposed improvements, which be deemed benefited thereby, were
propertly notified of said hearings, and
4. That the City Manager shall also llst the names and owners of the several parcels
so improved as nearly as can be ascertained.
5. That the City Manager shall proceed with taking of bids for the improvements,
or portions of the improvements as stated herein.
6. These improvements shall also be known as P.I.R. #823 - Project #8601.

The resolution was offered by Petkoff, seconded by Paulson with the deletion of
the following alleys: Main Street to 2nd Street, 42nd to 43rd Avenues and Quincy
Street to Jackson Street, 42nd to 43rd Avenues.
Motion to amend by Nawrocki, second by Peterson to add back the two above-mentioned
alleys to the resolution. Roll call on amendment: Peterson, Nawrocki - aye
Paulson, Petkoff, Carlson - nay Motion .to amend fails.
Councilmember Peterson stated that his reason to approve the entire project is that
these alleys al1 need maintenance. Mayor Nawrocki concurred and again said this
entire project has been discussed at great length.
