Roll Call Paulson, Carlson, Peterson, Nawrocki - Present Petkoff - Absent 2. Invocation There was no invocator available to give the invocation. Consent Agenda Motion by Paulson, second by Peterson to approve the following items as presented on the consent agenda. Roll Call: All Ayes. Minutes of Previous Meeting(s) The Council approved, as written, the minutes of the Regular City Council Meeting of November 23rd, and the Special Assessment Hearing of November 30th. Moving of Office Equipment for Carpet Installation The Council ratified the action of the City Manager to expend $600 for moving office equipment by Commers Interiors in conjunction with the City Hall carpet installation· 1987 Brochure Contract Amendment The Council authorized the Mayor and City Manager to amend the executed contract with Nystrom Publishing Company from $13,000 to $13,860 for the publication of one twenty page and three twenty-eight page brochures. Holiday Advertising at Top Valu The Council authorized the Mayor and City Manager to enter into an agreement with the Star & Tribune for a two-day advertisement of liquor store merchandise at a cost not to exceed $4,700. Purchase of Four 1988 Chevrolets for Police & Fire Departments The Council authorized the purchase of four 1988 Chevrolets from Thane Hawkins Polar Chevrolet via Hennepin County Contract #8511; the Police Department is authorized three vehicles with cloth seats at $11,832 each, plus one parts manual at $35 and one service manual at $45, for a total of $35,576; the Fire Department is authorized one 1988 Chevrolet with cloth seats, for a total price of $11,832; and, furthermore, the Mayor and City Manager are authorized to enter into a contract for the above vehicles. Purchase of Crime Prevention Signs The Council authorized the purchase of 1,000 window decals at $1,000, 50 12" x 18" street miens at $425, and four magnetic signs at $24 for a total of $1,449 from the Sign Center in San Diego, California; and, furthermore, the Mayor and City Manager be authorized to sign a contract for the signs. Purchase of Street Sweeping Brooms The Council authorized the purchase of 90 - 10" x 36" wire sectional brushes and 100 - 10" x 36" plastic sectional brushes and one broom (S37022) from Old Dominion Brush Company under Hennepin County Contract #8512-B for a total amount of $1,094.80. Continuation of Regular Council Meeting Page 2 Meeting of December 15, 1987 Final Payment for Projects 8010, 8210, 8303, 8513, 8102, 8301, 8411, and 8511 The Council accepted the work under Projects 8010, 8210, 8303, 8513, 8102, 8301, 8411, and 8511, and authorized the final payment of $28,430.58 to Bituminous Roadways, Inc. of Minneapolis, all in accordance with the agreement entered into with Bituminous Roadways, on September 14, 1987. Permission to Seek Bids for New Radio Equipment The Council authorized the City Manager to call for formal bids for Public Works and Fire radio equipment as proposed in the draft specifications by Dr. DuBois. Purchase of Traffic Counter/Speed Survey Indicator The Council authorized the City Manager to purchase two Streeter Richardson TraflCOMP III Traffic Counting and Classification System units from ACT Electronics, Inc., of Eden Prairie as a proprietary purchase for $2,750.00. Appointment of Secretary Pro-Tem Motion by Paulson, second by Carlson to appoint Bonnie Jewett as Secretary Pro-Tem. Roll Call: All Ayes. Oral Petitions There were no oral petitions. 6. Ordinances and Resolutions Second Readin~ of Ordinance No. 1158; Being an Ordinance Vacating an Alley--First Lutheran Church--Motion by Carlson, second by Peterson to waive the reading of the ordinance, there being ample copies available to the public. ORDINANCE NO. 1158 BEING AN ORDINANCE AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, VACATING A CERTAIN ALLEY The City of Columbia Heights does ordain: Section 1: The City of Columbia Heights herewith vacates the public alley over, across, and under the following described property,to wit: The alley separating Block 20 from Block 19 in Walton's Second Subdivision of Reservoir Hills, according to the recorded plat thereof on file and of record in the office of the County Recorder in and for Anoka County, Minnesota. ~ection 2: This ordinance shall be in fUll force and effect from and after thirty (30) days after its passage. RESOLUTION 87-64 BEING A RESOLUTION ESTABLISHING THE COMPENSATION OF THE INSURANCE COMMISSION CHAIRMAN FOR 1987 BE IT HEREBY RESOLVED that the City Council of the City of Columbia Heights establishes the amount of renumeration for Chairman of the Insurance Commission as follows: Effective January 1, 1987 -December 31, 1987 · · · $3,000 Passed this 15th day of December, 1987 Offered By: Seconded By: Roll Call: Paulson Peterson Paulson, Carlson, Peterson, Nawrocki - Ayes Petkoff - Absent 6A. Public Hearing--Condemnation of $728 Hayes Street NE Staff presented a brief history of the facts leading to the proposed condemnation of 3728 Hayes Street. The City Attorney indicated the structure was not razed nor violations corrected; and, therefore, staff was asking the City Council for an order to demolish the building. Dan Tenney, 3804 Hayes, and Bev Nelson, 3800 Hayes, were present and expressed concern regarding the hazards created by the building on this parcel. Marie Porter, owner, was present and responded to the questions of the Council. Motion by Paulson, second by Peterson that Council adopt the Findings of Fact, Conclusions of Council and Order dated December 15, 1987, to raze, demolish and remove the structure at 3728 Hayes Street; and, furthermore, to authorize the Mayor and City Manager to execute an order for same. Such order under this motion would be that the home and garage at 3728 Hayes Street NE must be razed, demolished, and removed; the site must then be restored to a safe condition with fill as necessary. Such correction shall be completed within thirty days of the services of this order. If the order is not carried out in a prescribed time, the order will then be taken to Court. Jim McMurchie, brother-in-law of Marie Porter and residing at 2538 Jefferson, confirmed with the Mayor and Council that the motion, as regards court proceedings, would not take affect for thirty days· If they agree to have the City take bids for the removal of the building and the agreement is signed within thirty days, there will be no court proceedings. The City would have the ordered carried out and the parcel restored, with costs being assessed against the property unless previously paid. Roll Call: All Ayes. Planning and Zoning Commission--Lot Split, Minneapolis Electric Steel, 3901 University Avenue Roy ~oranson, Building Inspector, reviewed with the Mayor and Council the request made by Mr. Dennis Buratti, Attorney representing Minneapolis Electric Steel Castings Co., for a lot split of the property located at 3901 University Avenue ME. Fred Salsbury, City Engineer, indicated: the City needs to acquire the necessary easements for storm water drainage; Minneapolis Electric Steel Castings has not presented title of ownership to date; and specifics stated in a letter from Andy Fulton, Plant Manager, dated December ~, ~987, responding to a memorandum written by.the Assistant City Engineer on December 4, ~987, need to be completed. Mr. & Mrs. Bruce Shellito, ~0~ S-mmit Street NE, expressed concern with regard to the splitting of parcels since parking problems were experienced by the neighborhood when the plant was previously in full production. Tom McMullom of Macoo Enterprises, highlighted briefly Mr. Macoo's past business experience in material handling. The City Attorney requested this item be tabled for a few minutes while he revise the resolution to reflect the concerns presented by the Mayor and Council and staff. be Councilmember Ed Carlson, representative on the Traffic Commission, indicate the minutes have not been approved by the Commission and are for informational purposes only. Ce Authorization to Enter into a Renewed Agreement with Metropolitan Waste Control Commission--Motion by Carlson, second by Paulson that the Mayor and City Manager be authorized to enter into a renewed agreement with Metropolitan Waste Control Commission for joint use rental agreements between the City and Metropolitan Waste Control Commission. Roll Call: Ail Ayes. For the record, Mayor Nawrocki indicated he received a letter from the architect dealing with services rendered at the John P. Murzyn Hall facility. The Mayor will review the statement with staff. 8. Old Business Designation of One-Way Drive at John P. Murzyn Hall Parking Lot--Before a one-way drive is designated, it was decided residents should again be questioned to see if a traffic-related problem actually exists. Motion by Peterson, second by Paulson to refer this item to the Traffic Commission to be pla, ed on their agenda, and for the Traffic Commission to inform the affected residents of such. Roll Call: Ail Ayes. New Business Awarding of Bids for Mew Cooler, Liquor Store #3--The original budgeted amount for improvements at Liquor Store 13 will be exceeded by approxi- mately SB,000. Continuation of Regular Council Meeting Page 10 Meeting of December 15, 1987 de Ratify Action of the City Manager in Seeking Bids for the Custodial Service--Moved by Peterson, second by Paulson to ratify the action of the Clty Manager authorizing the seeking of bids for the custodial service at City facilities. Authorization to Seek Quotations for Additional Data Processing Equipment--Motion by Paulson, second by Carlson to authorize the City Manager to seek written price quotations on additional data processing equipment, as outlined in the Finance Director's memo dated December 9, 1987. Roll Call: All Ayes. City Insurance--Motion by Paulson, second by Carlson to continue self insuring liability exposures and to authorize the City Manager to seek premium quotes for the renewal of property insurance coverage; and, furthermore, to accept the City's Self Insurance Claim Handling and Administration Program, dated September l~th, as previously submitted to the Council. Roll Call: Ail Ayes. The Mayor expressed concern that staff should be seeking proposals for alternative methods of handling claim adjustments. 10. Reports Report of the City Manager The City Manager's Report was submitted in written form and the following items were discussed. 1. Letter from Sergeant Richard Schmidt regarding Half-Day Off in Celebration of the Minnesota Twins Parade--The intent of the City Council was to allow those that could get away the opportunity to do so; it was not intended to give an extra half-day holiday to employees. 2. Outdoor Warning Sirens--The City Manager was instructed to listen to the tape from the meeting of October 12, 1987. The item will be presented for Council action on December 28, 1987. 3. Skating Rink/Warming House Matting--The Public ~orks Director is to seek alternative bidding for a Wflip-it" matting versus the runner- type matting. A decision will be made by the Council once quotations are submitted for review. ~. Rice Creek Watershed District and Environmental Resources - Metropolitan Council--The City Manager distributed copies of letters forwarded to the above agencies dealing with the Water Management Plan. The Mayor asked for an update on the status of comparable worth. The City Manager and Administrative Assistant need to continue an analysis. This will hopefully be furnished to the Council in a formal report upon the City Manager's return from vacation. Mayor Nawrocki asked the City Manager the status of amendments to the 1988 Budget. The City Manager indicated his understanding was that the matter would not be addressed before the end of the year. However, staff would probably have a resolution to the City Council at the January 11, 1988, Council Meeting. Continuation of Regular Council Meeting Page 1 1 Meeting of December 15, 1987 The Mayor asked the status of Cable TV meeting the requirements of the franchise regarding the rate increase and changes in local access programming and channels. The City Manager indicated the Columbia Heights/Hilltop Cable Communications Commission will be meeting December 17, 1987, to discuss: allocation of access channels; negotiation of transfer of access channels; service at Hurzyn Hall; requirements under franchise regarding limitations of pay channels versus basic subscriber service; and the reasonableness of the rate increase. The rate adjustment was done in accordance with the franchise and will be effective January 1, 1987. With regard to the capability, the headend would need to be changed if a FM feed forward is used. The cable company feels the FM capability was a typographical error. The Cable Commission disagrees and is looking towards negotia- tions of the item; it will again be discussed at the December 17, 1987, Cable Communications Commission Meeting. Report of the City Attorney The City Attorney reported he received a call from an insurance company representing Antco relating to the lawsuit of Hayes Contractors. An agreement has been made to make satisfactory pa2ment to Hayes without the City's participation. 11. Licenses Motion by Paulson, second by Peterson to approve the licenses as listed and to waive the fees as indicated. The Building Inspector will provide information to Councilman Peterson regarding the businesses listed for waived fees. Roll Call: Ail Ayes. The Building Inspections Office is currently requesting workers' compensation verification from businesses seeking licenses. Applicants will be informed that beginning January 1, 1988, the application process will not be completed until applicants present acceptable evidence of workers' compensation insurance coverage. 12.
