BACKGROUND
h~ October 2004, Star Central first approached the city about the possibility of going to a 2:00 a.m. bm' closing
time. This is allowed at the discretion of each city by the State of Minnesota. At that time, I had put together
information for the City Council, Milch I have copied and attached to this memo. At the request of Council
Member Nawrocki, I also had our staffcheck with the City of Milmeapolis to get a copy of their ol'dinmace and
to find out issues they have had with the 2:00 a.m. bal' closing.
We spoke to a party named Ross at the City of Milmeapolis Liquor Licensing. He stated there is an additional
cost to processing these requests, which ultimately nmst be sent to the State of Mimaesota for final approval.
He also stated that the police department is incmTing additional ovellime costs. Ross refen'ed us to the City of
Hopkins, which charges an additional fee and restricts the 2:00 a.m. closing to Friday, Saturday, Sunday, and
certain holidays. I have attached the fee schedule and ordinance to this memo.
There was also an article in the Sun Focus reference 2:00 a.m. bar closings, which noted that of the 11,000
bars statewide, only 910 have gone to a 2:00 a.m. closing time. Of the 910 that have chosen to do so, 567 of
them are in the seven-county metro area.
It should also be noted that as of August 1, 2005, the legal limit to ch-inlc and drive goes to .08. I aln not sure
what an extra hour of dril~ldng will do to the number of drul~k drivers on the road, but it should be noted that
the probable cause needed to stop a drunk ch-iver has not changed. Some illegal driving activity must be
observed. I have obtained and attached the DWI lmmbers and the domestic numbers from 2003 and 2004. It
is interesting to note the increase of DWIs after 2:00 a.m. and the increase in domestics after 2:00 a.m. fi:om
2003 to 2004.
ANALYSIS/CONCLUSION
After looking at several city ordinances and talldng to several police chiefs, I have determined there are many
unlmowns as to what exactly will happen when and if we go to a 2:00 a.m. bar closing. I do feel it will have
an effect on the lmmber of DWIs, domestics, public urination, public fighting, and loud music complaints
after 2:00 a.m. in the morning.
If we are going to proceed with this change, the police department suggests we look closely at the process the
City of Hopkins is using and limit our increased overtime costs by limiting the days when 2:00 a.m. closing is
allowed. This would be Friday, Saturday, Stmday, and holidays. We would also suggest that this ordinance
have a sunset clause so that activity levels cma be reviewed in two years and, if needed, the ol'dinance could be
changed or repealed.
The City Attorney has reviewed and suggested the attached ordinance for our city to adopt.

available for the public.
Motion: Move to schedule the second reading of Ordinance No.1483,being an ordinance amending
Ordinance 853, City Code 1977, allowing bars that obtain a permit fi'om the City to close at 2:00 a.m. on
Friday, Saturday, Sunday, and holidays.

could only close at 2 a.m. on Fri-
days, Saturdays and holidays.
Ever since the 2003 state Legis-
lature approved late closings,
with a fee of course, a limited
number of bars and restaurants
have actually taken advantage.
According to a WCCO-TV Reality
Check from November 2004,
11,000 bars statewide are eligible
to stay open until 2 a.m. Only 910
have chosen to do so; 567 of them
are in the seven-county metro
area.
Some of these bars are in
neighboring cities of Columbia
Heights. Minneapolis, Fridley,
MoQnds View and New Brighton
all have approved ordinances al-
lowing the late close -- each cry
has to approve its own ordinance
with its guidelines.
Fridley allows bars to stay
open late seven days a week, not
just Fridays, .Saturdays and holi-
days.
Since the ordinance took effect
in Fridley last September, The

Section 1200- intoxicating Liquor
1200.01. Provisions of the State Law adopted.
The provisions of Minnesota State Statute, Chapter 340A,
relating to the definitions of terms, licensing, consumption, sales,
financial responsibility of licensees, hours of sale and all other
matters pertaining to the retail sale, distribution, and
consumption of intoxicating liquor are adopted and made a part
of this ordinance as if set out in full.
1200.03. Licenses Required.
Subd. 1, General requirement. No person, except a wholesaler
or manufacturer to the extent authorized under state license,
shall directly or indirectly deal in, sell, or keep for sale in the City
of Hopkins, any intoxicating liquor without a license to do so as
provided in this ordinance. Liquor licenses shall be of eight
kinds:

will be attributable to the sale of food.
Subd, 3. Each establishment granted an on-sale liquor license under this section shall have the continuing
obligation to have at least fifty percent of gross receipts from the establishment during the preceding business
year attributable to the sale of food.
Subd, 4. For the purpose of this requirement, "establishment" shall include the food and beverage portion of a
multi-service establishment. Financial records for the food and beverage portion must be maintained separately
from the records of the remainder of the establishment.
Subd. 5. For the purpose of this section, "sale of food" shall include gross receipts attributable to the sale of food
items, soft-drinks and nonalcoholic beverages. It shall not include any portion of gross receipts attributable to the
nonalcoholic components of a plain or mixed alcoholic beverage, such as ice, soft-drink mixes or other mixes.
Subd. 6. The Council may require the production of such documents or information, including, but not limited to,
books, records, audited financial statements, or pro forma financial statements as it deems necessary or
convenient to enforce these provisions. The Council may also obtain its own audit or review of such documents or
information, and all licensees shall cooperate with such a review, including prompt production of requested
records.
Subd. 7. In addition to other remedies that it may have available, the Council may place the license of any on-sale
liquor licensee on probationary status for up to one year, when the sale of food is reported, or found to be, less
than fifty percent of gross receipts for any business year. During the probationary period, the licensee shall
prepare any plans and reports, participate in any required meetings, and take other action that the Council may
require to increase the sale of food.

Subd. 8. The above provisions shall not apply to any business having an on-sale liquor license prior to July 1,
1999 and will not affect the future renewals of the on-sale licenses for such businesses. These provisions shall
not apply to new licenses issued for existing establishments, due to sale or transfer of ownership of these
establishments, unless the establishment has been closed and without a liquor license for at least 90 days. These
provisions shall also not apply to any new on-sale liquor license for a hotel or bowling alley.
1200.07. On-Sale wine licenses.
Subd. 1. On-sale wine licenses shall be issued only to restaurants meeting the qualifications of Minnesota
Statutes Section 340A.404. Subdivision 5, and shall permit only the sale of wine not exceeding 14 percent alcohol
by volume, for consumption on the licensed premises only, in conjunction with the sale of food.
Subd. 2. The holder of an on-sale wine license who is also licensed to sell 3.2 percent malt liquors at on-sale and
whose gross receipts are at least 60 percent attributable to the sale of food, may sell intoxicating malt liquors at
on-sale without an additional license.
1200.09. Temporary on-sale licenses.
Subject to the approval of the commissioner of public safety, temporary on-sale licenses shall be issued only to
clubs or charitable, religious, or other non-profit organizations in existence for at least three years. A temporary
license authorizes the on-sale of intoxicating liquor in connection with a social event within the city sponsored by
the licensee and subject to restrictions imposed by the state liquor act.
1200.11. Off-sale licenses.
Off-sale licenses shall be issued to exclusive liquor stores and shall permit off sales of liquor only. No off-sale
license shall be issued to an establishment holding an on-sale liquor license except those on-sale and off-sale
licenses that are presently existing in such combination. The sale of such an establishment shall not prevent the
new owners from applying for an off-sale liquor license. At any time hereafter that any such existing combined on-
sale and off-sale licenses are for any reason suspended, canceled, or not applied for, no further re-issuance or
renewal of such licenses shall thereafter be allowed or issued in combination.
1200.12.
No new off-sale license shall be granted for any building within 350 feet of any elementary or secondary school;
daycare center; or religious institution. Furthermore, no new off-sale license shall be granted for any building
within 350 feet of any existing liquor store, pawn shop, licensed currency exchange, or any business licensed
under Section 1165 of the Hopkins City Code (Adult businesses). For purposes of this ordinance, this distance
shall be a horizontal measurement from the nearest existing property line of any church site, school site, day care
site, or the site of any existing liquor store, pawn shop, licensed currency exchange, or any business licensed
under Section 1165 of the Hopkins City Code, to the nearest property line of the proposed off-sale liquor site.

1200.13, Special club licenses.
Special club licenses shall be issued only to incorporated clubs or congressionally chartered veterans'
organizations that have been in existence at least three years.
1200.15. Special license for Sunday sales.
A special license authorizing sales on Sunday in conjunction with the serving of food may be issued to any hotel,
restaurant, Bowling Center or club which has facilities for serving at least 30 guests at one time, and which has an
on-sale license.
1200.17. 3.2 percent malt liquor, on-sale.
An on-sale 3.2 percent malt liquor license may only be issued to drugstores, restaurants, hotels, clubs, bowling
centers where food is prepared and served for consumption on the premises and in bona fide clubs, and shall
permit the sale of beer for consumption on the premises only.
1200.19.3.2 percent malt liquor, off sale.
Subd. 1. A 3.2 percent off-sale malt liquor license may be issued to permit the sale of beer in the original
packages for removal from and consumption off the premises only.
Subd. 2. Exemptions.
a. Any person licensed to sell intoxicating liquor at on-sale shall not be required to obtain a 3.2 pement malt
liquor on-sale and may sell 3.2 percent beer at on-sale without further license.
b. Any person licensed to sell intoxicating liquor at off-sale shall not be required to obtain a 3.2 percent malt
liquor off-sale license and may sell 3.2 beer without further license.

1200.21. Temporary 3.2 percent malt liquor.
A club or charitable, religious, or nonprofit organization may be issued a temporary on-sale license for the sale
and consumption of 3.2 percent malt liquor. The issuance of such license shall be made in accordance with city
policy.
1200.23. Application for License.
A person desiring any license for either on-sale or off-sale of liquor, wine, or 3.2 percent malt liquor must file an
application in writing with the clerk in the form prescribed by the commissioner and with such additional
information as the council may require.
1200.25. Payment.
Each application for a license shall be accompanied by payment in full of the license fee and the investigation fee.
Each license shall be issued for a period of one year except that if the application is made during the license year,
then the license fee shall be one-fourth of the fee for each three months or part thereof for the remainder of the
license year.
1200.28. investigation/Granting of License.
The council shall cause investigation to be made of all representation set forth in the application. No license shall
be issued, or renewed if the results show to the satisfaction of the council that issuance would not be in the public
interest. Opportunity shall be given at a regular or special meeting of the council to any person to be heard for or
against the granting of any license. After such investigation, the council shall grant or refuse such license in its
discretion provided that no off-sale, wine, or club license shall become effective until it, together with the security
furnished by the applicant has the approval of the commissioner. The fee for such investigation shall be set from
time to time by resolution and shall be payable by the applicant whether or not the license is granted.
1200.30. Refunds.
No refund of any fee shall be made except as authorized by statute.
1200.32. Proof of Financial ResPonsibility.
No liquor license may be issued, maintained, or renewed unless the applicant demonstrates proof of financial
responsibility as defined in Minnesota Statutes Section 340A.409 with regard to liability under the statutes,
Section 340A.801. Such proof shall be filed with the commissioner of public safety. Applicants for liquor licenses
to whom the requirement for proof of financial responsibility applies include all applicants for wine and 3.2 percent
malt liquor licenses. Any liability insurance policy filed as proof of financial responsibility under this subdivision
shall conform to Minnesota Statutes Section 340A.409. Temporary liquor license applicants shall provide
aggregate limits of one million dollars.
1200.34. Payment of Taxes and other Fees.
Subd. 1. No License shall be granted for operation on any premises upon which state or city taxes, assessments
or other financial claims of the state or city are delinquent and unpaid. Any existing license may be suspended or
revoked until such time that delinquent or unpaid tax or assessment, or other financial claim is paid in full. At such
time that all delinquent or unpaid taxes or assessments or other financial claims are paid in full, a revoked or
suspended license shall be re-issued for the remainder of the license period without additional application or
payment by the licensee.
Subd. 2. Notwithstanding the foregoing, if the delinquent taxes, assessments or other financial claims are against
a landowner, and the licensee is a tenant of the landowner and has no financial interest in the landowner, then the
City Council may, but shall not be required to, grant a license to an applicant so long as the applicant is not
delinquent on any taxes, assessments or other financial claims as set forth herein.
1200.36. Posting.
Licensed premises shall have the license posted in a conspicuous place therein at all times.
1200.38. Renewal of License.
Subd. 1. Time for Renewal. Applications for renewal of an existing license shall be made at least sixty days prior
to the date of the expiration of the license. If in the judgement of the City Council, good and sufficient cause is
shown by any applicant for his failure to file a renewal application within the time prescribed, the Council may
never the less receive such application.
Subd. 2. License Renewal Investigation. All renewal applications, which reflect a change of status, may be
investigated for verification of the matters set forth in the renewal application, which are updated since the last
application. If at the time of renewal, a change of the manager of the premises is identified, the licensee shall pay
a supplemental investigation fee which will be set from time to time by resolution and shall be payable whether or
not the license is granted.

1200.40. Transfer of License.
Subd. 1. No license shall be transferable between persons or to a different location. Any change in individual
ownership or substitution of partners will require application for a new license. For a corporation, a transfer or sale
of more than 10% of the shares will also require a new license. A transfer of stock without prior council approval
and an investigation is a ground for revocation of the license
Subd. 2. New licenses required under this section will require the full investigation fee to be paid by the applicant.
The license fee will be pre-rated according to Section 1200.25. (Amended by Ord. 2003-899)
1200.42. Conditions of license.
Subd. 1. General rule. Licenses granted under this section shall be granted subject to the following conditions of
this subsection, and subject to all other ordinances of the city applicable thereto and to all regulations
promulgated by the commissioner applicable thereto.
Subd 2. Conduct. Every licensee shall be responsible for the conduct of his licensed place of business and for
conditions of sobriety and order therein. No licensee shall keep, possess, or operate, or permit the keeping,
possession, or operation of, on the licensed premises, or in any room adjoining the licensed premises, any slot
machine, dice, or any gambling device or apparatus, nor permit any gambling therein, except that which is
approved by state statute, nor permit the licensed premises or any room in the same, or in any adjoining building,
directly or indirectly under its control to be used by prostitutes or other disorderly persons.
Subd. 3. Sales prohibited. No intoxicating wine, liquor or malt beverage shall be sold or furnished for any
purpose whatever to a person under the age of 21 years, or to a habitual drunkard, or to a person under
guardianship, or to any person obviously intoxicated, or to any of the persons to whom sale is prohibited by
statute.
Subd. 4. Character. A license may not be issued to a person not a citizen or resident alien of the United States
and a licensee shall be of good moral character and repute. A license may not be issued to any person who shall
hereafter be convicted of any willful violation of any law of the United States or the State of Minnesota or of any
local ordinance with regard to the manufacture, sale, distribution or possession for sale or distribution of
intoxicating liquor, nor to any person whose license under this section shall be revoked for any willful violation of
any such laws or ordinances.
1200.44: Additional conditions of intoxicating liquor licenses and the operation of licensed premises,
Subd. 1. The following acts or conduct on licensed premises deemed and decreed to be contrary to public welfare
and morals and, therefore, no on sale liquor license shall be operated, maintained or allowed at, in or on any
premises where such acts or conduct are permitted or tolerated. No licensee shall employ, permit or encourage
any person or employee in or on any such licensed premises in or under any of the following circumstances:
a. while such employee or person is unclothed or in such attire, costume or clothing as to expose any
portion of the female breast below the top of the areola, or any portion of the pubic hair, anus, cleft of the
buttocks, vulva or genitals; or
b. while such employee or person encourages or permits the wear or use of any device or covering
exposed to view which resembles or simulates the breast, genitals, anus or other portion of the body above
mentioned; or
c. while such employee or person permits or encourages any person to perform or simulate the
performance of sexual intercourse, sodomy, oral copulation, flagellation, masturbation/bestiality or other acts
prohibited by law; or
d. while such employee or person encourages or permits any person to use artificial devices or inanimate
objects to depict any of the prohibited activities herein described; or
e. while such employee or person encourages or permits any person on the licensed premises to touch,
caress or fondle the breasts, buttocks, anus or genitals of any other person; or
f. while such employee or person encourages or permits any of the behavior, conditions or acts
hereinabove set forth by any other person or persons.
Subd. 2. Whenever the term "person" is used in this section, it is intended to mean and shall include but not be
limited to, any host, hostess, other employer or employee, customer or spectator and all provisions of this section
shall apply equally to both sexes.
1200.46. Hours of operation.
Subd, 1. No sale of 3.2 percent malt liquor may be made between 1 am and 8 am on the days of Monday through
Saturday, nor between 1 am and 12 noon on Sunday, except as stated in Section 1200.46, Subd. 4. (Amended by

Subd.2, Intoxicating liquor; on-sale. No sale of intoxicating liquor for consumption on the licensed premises
may be made:
1. between 1 am and 8:00 a.m. on the days of Monday through Saturday;

1200.48. Evacuation of Licensed Premises.
Subdivision 1. No licensed premises named in an ON SALE Intoxicating Liquor License shall remain open for
business more than 15 minutes after the closing time stated in section 1200.46, Subd. 2 and Subd. 2 of this
Ordinance. It is unlawful for a licensee or an employee of a licensee to permit any person, other than a licensee or
an employee, to remain on said licensed premises more than 15 minutes after closing time. It is also unlawful for
any person, not a licensee or employee of a licensee, to remain on said licensed premises more than 15 minutes
after closing time.
Subd, 2. No licensee or employee of a licensee shall consume alcohol or permit the consumption of alcohol on
the premises after closing as stated in section 1200.46, Subd. 2 and Subd. 4. (Added by Ord 2003-899)

I spoke this monfing with Ross at the City of Minneapolis, Liquor Licensing, 612-673-
2551.
He directed me to the Milmeapolis ordinances on their web Site. Chapter 364 (attached)
deals with Liquor Regulations, and 364.80 covers Hours, days regulated. Ross said this
section was recently amended to allow establishments to remain open until 2 AM.
He explained that liquor license holders that wish to remain open until 2 AM must obtain
a license fi:om the State of Milmesota to allow them to do so. Establishments without that
State license must not sell alcohol past 1 AM.
Ross mentioned that some cities, like Hopkins, charge an extra license fee for
establishments that have the 2 AM license from the State. He believes Hopkins charges
$700 per year in addition to their normal liquor license fee. This goes to cover additional
administrative expenses (he said there is additional paperwork fi:om the State for those 2
AM licensees) and the potential additional law enforcement costs due to the additional
hour of operation.
He noted that Minneapolis may be considering adding ail additional fee as well, as his
office has seen an increase in administrative costs related to those licenses.
Ross said he is available to answer any additional questions you may have. He also said
Jackie Hanson in the Minneapolis City Clerk's office, 612-673-2046, is very familiar
with their liquor regulations ordinance and would be a good reference person if you need
additional info.

364.1:0. Furnishing to minors. No holder of an "off sale" liquor license, nor any agent or employee of
such license holder, shall deliver any intoxicating liquor to any person under twenty-one (21) years of

364.20. Receipt for deliveries. No holder of an "off sale" liquor license, his or her agent or employee,
shall deliver any such intoxicating liquor to or at any place or premises other than those for which such
license shall have been issued, without obtaining a receipt therefor, in duplicate, signed by the person
receiving such liquor, in plain and legible writing and bearing the time and date of such delivery, and
address of the place, including number of room or apartment, if any, where such liquor is delivered. The
original of such receipt shall be kept in the files of the licensee for a period of at least one year from and
after the date of such delivery, and all such files and receipts shall .be kept available for inspection by the
police department at all hours during which such place of business may be open under the terms of this

364.40. Consuming in public. No person shall consume intoxicating liquor as defined by Minnesota
Statutes, Section 340A.101, Subdivision 14, or nonintoxicating malt liquor as defined by Minnesota
Statutes, Section 340A. 101, Subdivision 19, while (1) on a public street, highway, alley, Sidewalk,
boulevard, or any place frequented by the public; (2) on any private property without the consent of the

364.45. Loitering in possession of open bottle. No person shall loiter in any public street, highway,
alley, sidewalk, boulevard or any other public property, or on any private property without consent of the
owner of such property, while in possession of any bottle or other receptacle containing intoxicating liquor
or non-intoxicating malt liquor which has been opened, or the seal broken, or the contents partially
removed, with intent to consume such intoxicating liquor or .non-intoxicating malt liquor.
This section shall not prohibit the possession of alcoholic beverages at duly licensed on-
sale premises if otherwise authorized by law.

364.50. Taking liquor to another liquor or beer place. No person shall take or carry any liquor to or
into. an.y. building or place, or consume any liquor purchased elsewhere, in any building or place operated.
under an ,'on sale" license or under a beer license granted by the city council; nor shall any "off sale"
licensee knowingly sell or permit to be sold to any person any liquor for transportation to or consumption
in any such place operated under an "on sale" license or beer license. This section shall not apply to

364.60. Sales in hotel rooms. No sale of liquor shall be made to or in guest rooms of hotels, unless the
rules of such hotel provide for the service of meals in guest rooms; nor unless the sale of such liquor is

made in the manner "on sales" are required to be made; nor unless the rules of such hotel and the
description, location and number of such guest rooms are fully set out in the application for a license;
provided, however, that hotels may install and operate mechanical dispensing systems for alcoholic

364.70. Bars. No public bar, other than a service bar, shall be permitted in any place licensed under "on
sale" license, unless it is equipped for the service of food and drink and unless such service is to patrons
in full view of and conducted as a part of the service of the dining room or one of the additional rooms of a
hotel, restaurant, cafe or club in which the sale of intoxicating liquor has been authorized by the license.
This section shall not apply to establishments for the sale of "on sale" liquor exclusively. (Code 1960, As

364.80. Hours, days regulated. (a) No on-sale of liquor may be made:
(1) Between 2:00 a.m. and 8:00 a.m. on the days of Monday through
Saturday;
(2) After 2:00 a.m. on Sundays, except with a valid Sunday sales license as
provided in subsection (c).
(b) No off-sale of liquor may be made:
(1) On Sundays;
(2) Before 8:00 a.m. on Monday through Saturday;
(3) After 8:00 p.m. on Monday through Thursday and after 10:00 p.m. on
Friday and Saturday, provided that an off-sale establishment may sell liquor until
10:00 p.m. on December 31 and July 3, and on the day preceding Thanksgiving
Day, except when those days fall on Sunday;
(4) On Thanksgiving Day;
(5) On December 25; or
(6) After 8:00 p.m. on December 24.
(c) Sunday sales. Establishments to which "on sale" licenses have been issued or
hereafter may be issued for the sale of intoxicating liquors which are hotels or
restaurants and which have facilities for serving not less than fifty (50) guests at one
time, may serve intoxicating liquors between the hours of 10:00 a.m. on Sundays and
2:00 a.m. on Mondaysin conjunction with the serving of food. It is unlawful for any such

during the hours when the "off sale" of liquor is prohibited. The requirements of this section shall not
apply to the proprietor of any store possessing an "off sale" liquor license where all the businesses on the
licensed premises are closed during the hours when the "off-sale" of liquor is prohibited. (Code 1960, As

364.100. "On sale" premises without special licenses to close certain hours. Every room, place or
premises where any liquor is permitted to be or is sold, including the cafe, restaurant or dining room
operated in connection therewith, or as a part thereof, and in which such liquor is sold or served by the
licensee thereof pursuant to an "on sale" license, shall be closed and kept closed to the public between
the hours of 2:30 a.m. and 5:00 a.m., unless the licensee is the holder of a special late hours license
provided for in sections 360.70, 360.75, and 360.80. During said hours, if the licensee is not the holder of
a special late hours license, no person shall be allowed to be or remain upon or within such room, place
or premises for any purpose whatever, except that the owner or licensee, his or her agents, servants or
employees may remain therein for the purpose only of cleaning, preparation of meals, necessary repairs

364.110. Restroom facilities required. In each establishment wherein liquor is sold pursuant to an "on
sale" license, there shall be installed and maintained at least one toilet room for each sex. In each toilet
room for use by women there shall be installed and maintained at least one water closet and one
lavatory. In each toilet room for use by men there shall be installed and maintained at least one water
closet, one lavatory, one urinal and a properly installed and maintained floor drain sufficient at all times to
keep such floor dry and in a sanitary condition. All water closet bowls shall be of extended lip pattern
styles equipped with an open front without covers, and shall at all times be kept clean, sanitary and in
good working condition. The floors and side walls, except doors, to a height of at least three (3) feet
above the floor, of all toilet rooms and urinal compartments shall be constructed of noncorrosive and
nonabsorbent materials, and approved by the director of inspections. Whenever possible, toilet rooms
shall not be installed in cellars or basements, but when necessary, toilets may be located in a basement.
When all toilet rooms are on the same floor, the entrances thereto shall be located as far apart as
practicable, and each shall be plainly marked to indicate whether for men or women. Stairways to
basement toilets shall be at least thirty (30) inches wide and of safe and substantial construction and with
sufficient headroom. An iron pipe or other suitable handrail or guide shall be installed for the full length of
such stairway, and the same shall be well lighted at all times. (Code 1960, As Amend., § 853.100)

As each of you is aware, Ken Kautz, club manager of Star Central Bar and Grill, submitted a letter to the
City Council on behalf of Star Central's owner Bruce Hilsen requesting the City Council consider
moving to a 2:00 a.m. bar closing.
Because of this request, I have checked with the cities around us to see what they are doing reference this
issue. St. Anthony Police reports they currently have no on-sale establishments and have not changed
their current 1:00 a.m. closing. They do not plan to address this until they have an on-sale establishment
some time in the future. Fridley Police Department reports they have enacted a new ordinance that
allows on-sale liquor establishments to apply for extended hours and they are looking at these
applications individually as they come in. Their ordinance also has a sunset provision in 2006 and their
city council will be looking at the ordinance at that time to determine if they wish to continue with it or
not. There is also a provision for an additional fee for this privilege, but the council has not set the fee at
this time. I was advised that two of their on-sale establistm-tents have applied for and have been given
permission to stay open until 2:00 a.m. At the time of this memo, I have not heard back fi'om the New
Brighton Police.
I have looked at a very narrow picture of DWI activity in our city near Star Central during the year 2003.
We looked at DWIs occurring from 37th to 45th on Central Avenue between 1:00 a.m. and 3:00 a.m.
There were 32 DWI arrests in 2003 in this area. I think it is safe to conclude that these arrests would
probably move to 2:00 a.m. if the bar closing were moved to that time. With our current schedule, this
would create additional overtime in order to process these DWIs. I would estimate that a routine DWI
takes one and one-half to two hours to complete.
At this time, the department's schedule is built around a 1:00 a.m. bar closing. Our slfifts rrm as follows:
7:00 a.m. to 5:00 p.nl.
Special shift, noon to 1:00 p.m.
5:00 p.m. to 3:00 a.m.
9:00 p.ln. to 7:00 a.m.

As you can see from this schedule, we have a mi~fimum of four officers on the street from 10:00 p.m. to
3:00 a.m. With a 1:00 a.m. bar closing, the bar rush and dm~c driver rush is under control by 3:00 a.m.
This is not to say that there are not drunk drivers after 3:00 a.m. It is saying that the bulk of the bm'
business--including drank drivers, bar fights, domestics, detoxification, hms from over consumption,
public urination in the parking lots, etc.--takes place during the hours of 10:00 p.m. to 3:00 a.m. when
we have our highest nulnber of officers available. If we change to a 2:00 a.m. closing, this pushes
everything forward for us, which would result in paying overtime or luajor scheduling adjustments.
I personally do not agree with the 2:00 a.m. bar closings, as I believe all tlfis does in encourage additional
consumption and creates an even more dangerous bar closing enviromuent. I would ask the City Cotmcil
to consider leaving bar closing at 1:00 a.m. so that we may continue to adequately cover the bar rush
time.
If the Cotmcil decides to push the time forward to 2:00 a.m., I would ask that we proceed as the City of
Fridley has, requiring each bar to apply for the extended hours and charging an extra fee for staying open
later. I would also ask that we sunset any ordinance change so that if we find this process does not work,
the extended hours ordinance will simply go away. I will report back mmually to the Council on the
number of incidents or issues we have related to the 2:00 a.m. bar closing. Lastly, if we were to give
Star Central an extended hours permit, I would like to see it conditional to all music stopping at 1:00
a.m. We have a long history of noise complaints with this location from the senior building located
behind this establislunent. I thi~c the se~fiors deserve to have 1:00 a.m. as the breakhug poh~t for noise in
the area.

We believe Star Central has tried very hard over the last 10 months to become a
good neighbor to the Columbia Heights Community. We have taken many steps
to improve the sound problems of the previous owner and hosted Senior Citizen
Luncheons to improve relations with our close neighbors. We have worked very
hard to educate our personnel to take a more kinder, gentler approach to our
patrons who may be experiencing a difficult evening. In short, we have tried to be
cooperative, community aware and prove ourselves capable of working within
the system.

We no longer have any on sale establishments in St. Anthony, except for a
wine and cheese shop that keeps very conservative hours. The Apache Wells
was torn down years ago, and the Stonehouse was recently demolished as part
of a redevelopment project. We still have 2 liquor stores, and a
bar/restaurant is supposedly coming.

Tlfis memo provides for the second reading of ordinm~ce revisions mnending Chapter 602, Chapter

The first reading was held during the August 23, 2004 meeting of the Fridley City Council. The
ordinm~ce has been revised as directed by Council during the first reading. The revised lm~guage

certification of their ratio of food sales as a part of total sales. Establisl2nents holding licenses to sell
liquor that do not apply for a Late Hour Endorsement will continue to be required to submit almual

required by Mim~esota State Statutes. No person shall sell any intoxicating liquor after 1:00
a.m. without obtaining a special Late Hour License Endorsement for m~ existing liquor license
as provided in this Chapter. No Late Hour License Endorsement grm~ted pursum~t to this
Chapter will be effective after April 30, 2006.
603.06 SUNDAY AND LATE HOUR LIQUOR SALES
The mmual license fee for "Sunday Liquor Sales" shall be provided in Chapter 11. The mmual
fee for a license endorsement for Late Hour Liquor sales after 1:00 a.m., but before 2:00 a.m.,
shall be provided in Chapter 11. These fees are in addition to the fee charged for an "on-Sale"
license. All provisions of this Chapter pertaining to the "on-Sale license shall apply to the
"Sunday Liquor Sales" license, and the Late Hour Endorsement, insofar as practicable.
603.07 GRANTING OF LICENSES
2. Renewal Licenses
At the earliest practicable time after application is made for a renewal of an "on-
sale" license, mhd in may event prior to the time the application is approved by the
City Council, the applicant shall file ~emim:nually with the City Clerk a statement
made by a Certified Public Accountm~t that shows the total gross sales and the total
food sales. A foreign corporation shall file a current Certificate Authority.
603.10 CONDITIONS OF LICENSE

Late Hour License Endorsement

sales, derived from the sale of food and intoxicating liquors of the establishment, for
which the "on-sale" license is to be used, is in the serving of food. "ProoF' for
purposes of this section, shall consist of not less that a statement of accuracy, attested
to by a certified public accountant, accompanying a verifiable, semimmual report of
sales receipts based upon acceptable mad recogmized accounting mad bookkeeping

Tom - Bob has asked me to respond to this question. Champps and Jake's
are the only two restaurants/bars that are licensed to be open until 2
am; and, Champps is only open until 2 am Thurs-Sun.
We have 4 other restaurants/bars that still close at 1 am. I did not
count the restaurants that have just wine licenses as they tend to close
by 10 pm. (Not much night life there!!)

I can guarantee we will have more shift holdovers. In all honesty though, I must say they have generated
relatively few calls for service.
FYI- Hilson never did go through with the employee training he was supposed to set up with Val. Vail
attempted several times to set it up. (I think he changed his mind about spending the $35.00 / head for
the workbooks.)

Walt just advised me that Bruce Hilson from Star Central has approached him requesting the city to
extend bar closing to 2:00 AM. I advised Walt that this would create a scheduling and overtime issue for
us in that our current schedule has its overlap and strength based on a 1:00 AM closing. Can you think of
any other arguments against the 2:00 AM closing time besides the schedule issue?

BACKGROUND
During the last month, there have been several articles in the Minneapolis Star Tribtme reference the
ultimate fighting matches taking place in Fridley, Minnesota and the Fridley City Council's attempt via a
new city ordinance to stop these matches at establishments selling alcohol. The new Fridley city
ordinance, which had its second reading during the week of February 25, 2005, will take effect in thirty
days. In one of the Star Tribune articles, the promoter of ultimate fighting said they would no longer
promote these fights in Fridley and that they would look for a new venue to stage these events. I have
obtained a copy of the new city ordinance that the City of Fridley has adopted and I gave it to our City
Attorney, Jim Hoeft, to review. Mr. Hoeft has advised me that the verbiage in the Fridley ordinance will
work for om' city, and the City Attorney and I suggest that we adopt this ordinance to prevent this type of
activity coming to our local bars.
ANALYSIS/CONCLUSION
It is the feeling of the police department and the City Attorney--and it is believed to be the consensus of
the city council--that ultimate fighting matches are not an activity we would want staged or promoted in
our city. Having this in mind, the police department and the city council recommend that the attached
proposed city ordinance prohibiting "certain exhibitions and conduct" on premises holding any type of
liquor license.
RECOMMENDED MOTION: Move to waive the reading of Ordinance No. 1482, there being
ample copies available for the public.
Motion: Move to waive the reading of Ordinance No. 1482, being an ordinance amending Ordinance 853,
City Code of 1977, to prohibit "certain exhibitions and conduct" on any premises holding any type of
liquor license in the city of Columbia Heights, for March 28, 2005, at approximately 7:00 p.m.

BACKGROUND
In October 2004, the Columbia Heights Police Department was successful in writing and obtaining a Homeland Security grant for
$186,000, with no required matching dollars. Part of this grant, $36,000, is to be used for purchasing a Reverse Dialing System.
Dm'ing the past several months, the City Manager, Finance Director Bill Elrite, IS Director Aleksandr ChmTdn, IS Technician Paul
Grosse, and the Ctiief of Police have been looking at existing systems to fred the best system for our city to purchase. The systems we
have looked at include Qwest Reverse Calling System, Reverse 911 Calling System and City Watch.
The Qwest System is the Ii'lOSt expensive of the three. This system is not on site and you are basically paying to rent the system frOli1
Qwest. You simply call in your recorded message and Qwest does the work of putting it out to the people in yom' city that you want to
receive it. It costs $25,000 initially and then $25,000 annually, plus $.23 per call thereafter. It was decided early on that this system
was out of our price range.
The Reverse 911 Calling System is the original Reverse Calling System, according to their sales associate. The company for this
system is based in Indiana, and to date there are no systems up and nmning in Minnesota. The cost for tiffs four-port system is
$25,707, plus there is a $2,000 annual fee. Besides the annual ~ee, there is an annual maintenance cost that includes upgrades in
software, which would be $3,132 annually.
City Watch Calling System is a local company located in Bloomington. Their system is installed in nkany Mhmesota locations,
including Fridley and Ramsey County. The cost for this eight-port system is $24,290.00. There is no annual fee. The ammal
maintenance fee would be 12% of the original purchase price of the system, or approximately $2,915. The maintenance includes 24/7
system support and software upgrades.
I have attached the quotes fromboth City Watch and Reverse 911 to tlfis council letter. There was no quote from Qwest--they simply
gave me their prices.
ANALYSIS/CONCLUSION
After having both the City Watch and Reverse 911 systems demonstrated to the IS Director, the IS Techitician, and the Chief of Police,
and after meetin~ with the City Manager and Finance Director to go over costs and pros and cons of each system, we are
recommending that we purchase the City Watch system. The reasons for this are: Local company

Child In Springfield...

The CityWatch Community Messaging
System from AVTEX, Inc. was solely
responsible for finding a lost child last
week in Springfield, Illinois.
Within minutes of being notified of the lost
child situation, Sgt. Bill Pittman of the
Springfield Police Department initiated an
out-call through CityWatch to all the
residents in the area where the child was
reported missing using the systems GIS
Mapping feature. In less then 1 hour of the
CityWatch message, the child was ibund by
a resident receiving the information from
CityWatch and the Police were notified.
The child was reunited with her parents.
"It's all about getting the word out in
emergency situations so citizens can help
us" says Sgt. Pittman. We have had major
successes with CityWatch for not only lost
children alerts, but also hazardous material

On February 18, 2005, the Chief of Police received the attached letter from Mr. Peter T. Kxvong, a local
business owner. Mr. Kxvong is putting together a police training video, where he xvould like to use the
video image of a Columbia Heights marked police vehicle. Mr. Kwong is requesting that xve allow him
to video a squad for 10-15 seconds xvhile it is driving with its lights and siren on. If this xvere approved,
the filming would take place in a controlled environment to limit any liability to the city. It is the police
department's understanding that this would be a for profit video that Mr. Kwong would sell to interested
law enforcement agencies.
ANALYSIS/CONCLUSION
While we do not make a habit of allowing our equipment to be used for enhancements, Mr. Kxvong is a
well-known businessman in our community and seems sincere in wanting to create this video to benefit
all of law enforcement. If the city council approves of this use of police department equipment, the
police department will closely monitor its use. No one other than a police department employee will be
driving the squad.

Serving on the Planning and Zoning commission would allow me to be an integral,
participative community servant within the city. I was bom and raised in Columbia
Heights. Until 1994 1 was co-owner/manager of a successful catering company within
the city. I feel a deep sense of loyalty, commitment and sentimentality toward the city of
my birth.
My qualifications are my thirty plus years business experience as a Columbia Heights
business woman and my experience and participation in working directly with the
Selection Committee responsible for the national and international search for the architect
for the new Guthrie Theatre project in downtown Minneapolis.
The firm I worked with on this committee was also respOnsible for the strategic real
estate planning and implementation of facilities and campuses for Medtronic's, Target,
Lutheran Brotherhood, Piper Jaffray and Fingerhut. I directly reported to one of the
principal's of the real estate advisors. I assisted in the analysis and coordination of the
Guthrie project and acted as the direct liaison with national and international clients and
generated reports, proposals and spreadsheets for the new Guthrie project.
