Hansen~)N BY: THE ZONE 6 2004 SEAL COAT PROGRAM DATE: 3/3/04~~2~'~ DATE: Background The City Council accepted the feasibility report and ordered an Improvement Hearing for March 9a~ at their meeting of February 9, 2004. Zone 6 is bounded by Central Avenue on the east, 40th Avenue on the south, University Avenue Service Drive on the west and 44th Avenue on the north. All local bituminous streets in Zone 6 are included, except University Avenue Service Drive and those streets that have been improved as part of the street rehabilitation program. Also included is 45th Avenue from University Avenue Service Drive to 5th Street. Analysis/Conclusions: Distributed at the February 9, 2004 regular City Council meeting was the Feasibility Report that details the scope of work and estimated costs for the Seal Coat Program in Zone 6. Prior to seal coating, concrete curb and gutter is repaired where feasible and the street surface is patched. Seal coat is an application of emulsion by mechanical sprayers immediately followed by spreading FA-3 granite as a cover aggregate. The road surface is finished by rolling with a tire-based roller for proper aggregate penetration and distribution. The following is a listing of streets recommended for seal coat: 4th Street, 40th to 44°~ Avenues 5th Street, 40th to 44th Avenues 6th Street, 40th to 44th Avenues Jackson Street, 40th to 41st Avenues 41 st Avenue, 4th Street to Central Avenue 42nd Avenue, University Avem~e Service Drive to Central Avenue 43rd Avenue, 4th Street to Central Avenue 45th Avenue, University Avenue Service Drive to 5th Street Assessment Methodology: Street Rehabilitation Zones 1, 2 and 3 all followed the existing assessment policies for each area. Under the 1999 Alley Construction Program and the Zone 4 through 6 Street Rehabilitation Program, a "unit" assessment methodology was employed rather than using a "front foot" rate basis. The area of Columbia Heights west of Central Avenue is essentially a block type development pattern with streets and avenues. The existing assessment policy for tlfis area would involve "street" assessments and "avenue" assessments. The "street" frontage (typical front of property or where driveway access is) would pay a particular rate for the full frontage on that street. That same parcel would pay a reduced rate for the avenue for the full frontage. Staff is reco~rmaending a unit basis assessment methodology in reconstruction areas as it has been my experience that the court system has accepted this rationale fi'om an appeal basis, in that residential parcels generally benefit equally from the same improvements. Going to a unit basis methodology would still create different rates for half a block; dependent upon the type of treatment the adjacent avenues receive. Avenue assessments are l/3 of the street rate extending ½ block in either direction of the Avenue. This assumes that all parcels benefit equally for the strategy in tSont of their property or abutting it, in the case of the Avenue. The estimated unit cost assessment is $207.00 per Street parcel and $69.00 per Avenue parcel. Past Assessments: Property owners assessed for a street or avenue parcel as part of the Street Rehabilitation program in Zones 6A and 6B may be assessed an avenue or street un/t, respectively for seal coat. Recommended Motion: Move to waive the reading of Resolution No. 2004-14, there being ample copies available for the public. Attachments: Resolution Assessment Rates Map Public Improvement Hearing Notice COUNCIL ACTION: RESOLUTION NO. 2004-14 BEING A RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS FOR ZONE 6 SEAL COATING CITY PROJECT 0301 WHEREAS, pursuant to Resolution 2004-06, adopted by the City Council on February 9, 2004, fixed a date for a Council hearing on the proposed improvements bounded on Central Avenue on the east, 40t~ Avenue on the south, University Avenue Service Drive on the west, 44~' Avemte on the north and 45th Avenue from University Avenue Service Drive to 5t~ Street, AND WHEREAS, ten days' mailed notice and two published notice of the hearing a week apart was given, and the hearing was held thereon the 9th day of March, 2004, at which all persons desiring to be heard were given an opportunity to be heard thereon, WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF COLUMBIA HEIGHTS, MINNESOTA: 1. Such improvement is necessary, cost-effective and feasible as detailed in the feasibility report. Such improvement is hereby ordered as proposed in the Council Resolution adopted 9th day of February, 2004. 4. These improvements shall also be known as P.I.R. #1078 - Project No. 0301 The City Engineer, Kevin Hansen, is hereby designated as the engineer for this improvement.
